Zülfiye KOÇAK Öz Şer'iyye Sicili veya Kadı Sicili olarak bilinen ve Osmanlı şehirlerinde görevli kadılar tarafından tutulan mahkeme kayıtlarını ihtiva eden defterler, bilhassa şehir tarihi çalışmalarının temel başvuru kaynaklarındandır. Bu kayıtlar sayesinde Osmanlı toplumunun sosyal, siyasal ve ekonomik yapısını ortaya koymak mümkündür. Çalışmaya konu olan 14 Numaralı Vidin Şer'iyye Sicili, Bulgaristan Ulusal Kütüphanesi'nin Şark kısmında bulunmaktadır. Bu defterde daha ziyade tereke, evlenme, boşanma, nafaka takdiri, miras davaları, gayrimenkul satışları, vesayet, narh tespiti, görevli tayinleri, vergi ve mukataa konularında tutulmuş 245 belge bulunmaktadır. Ayrıca merkezden yazılan fermanlar ve emirler de bu deftere kaydedilmiştir. Bu çalışmanın giriş kısmında Vidin'in tarihine dair kısa bir bilgi verildikten sonra çalışmaya konu olan defterin içeriğine değinilmiş ve daha sonra da özellikle XVIII. yüzyılda Osmanlı Devleti'nin Batı seferleri için oldukça önemli bir yerde bulunan ve yüzyılın başlarından itibaren "darü'l-cihad ve'l-mücahidin" olarak anılan Vidin'de 1699-1702 tarihleri arasında tutulmuş mahkeme kayıtlarına dayanarak, şehrin idari, ekonomik ve sosyal hayatı ortaya konulmaya çalışılmıştır.
İslâm dininin kurumlardan biri olan zâviyeler, herhangi bir tarikata mensup dervişlerin, bir şeyhin idaresinde topluca yaşadıkları yapı veya yapı topluluğunu ifade etmektedir. Osmanlı Devleti’nde ilk dönemlerden itibaren zâviye kurmak isteyen şeyh ve dervişlere, mirî topraklarda bir takım muafiyetler verilmek suretiyle destek verilmiştir. Bu nedenle Anadolu’da Osmanlı öncesi dönemlerde kurulmaya başlayan zâviyelerin sayısı Osmanlı döneminde her geçen gün daha da artmıştır. Özel mülkiyetten ziyade, geniş vakıf arazileri üzerinde birer tasavvuf müessesesi olarak kurulan bu zâviyeler, çoğunlukla şehir ve kasaba kenarlarında, yollar üzerinde veya geçit yerlerinde inşa edilmişlerdir. Zâviyeler kuruldukları yerlerde hem halkın manevi ihtiyaçlarını karşılayarak dini, hem de gelip geçen yolculara ücretsiz yiyecek, içecek ve yatacak yer sağlayarak sosyal fonksiyonlar üstlenmişlerdir. Bunun yanı sıra Anadolu ve Balkanlarda Türk-İslam kültürünün yayılmasına, göçebe yaşayan toplulukların yerleşik hayata geçmelerine ve böylece kuruldukları yerlerde yeniiskân alanlarının açılmasına da hizmet etmişlerdir. Bütün bu özellikler dikkate alındığında Osmanlı Devleti’nde zâviyeler; bir taraftan kendilerine özgü idari, yönetim, dini anlayış ve ritüellere sahip sosyal bir kurumu, diğer taraftan devletin en ücra köşelerinde hizmet vermeleri ve böylece Osmanlı idari düzeninin sağlanmasına yardımcı olmaları sebebiyle de sivil bir iktidarı temsil etmişlerdir. Osmanlı Devleti, egemenliğine aldığı şehirlerde kuruluşundan başlayarak Türk-İslâm kültürünü yerleştirmek ve kalıcılığını sağlamak amacıyla zâviye yapımını önemsemiştir. Osmanlı Devleti’nde pek çok müessese gibi zâviyeler de vakıf gelirleriyle faaliyetlerini sürdürmüşlerdir. Vakıflar, meydana getirdikleri sistem sayesinde gelir sağlayan ve elde ettikleri gelirlerle toplum ve devlet yararına çok çeşitli konularda hizmet üreten kurumlardır. Zâviyelerin ihtiyaçlarını karşılamak ve sürdürülen hizmetlerin devamlılığını sağlamak amacıyla çoğunlukla zâviye şeyhleri bazen de devlet yöneticileri tarafından kurulan veya desteklenen vakıflar, bu sosyal ve dini kurumların uzun yıllar varlıklarını sürdürmelerine yardımcı olmuşlardır. Tarihsel süreçte kurulduğu coğrafyadan dolayı birçok medeniyete ev sahipliği yapan Bitlis ve yöresi, 1515 yılında Osmanlı egemenliğine alındıktan sonra belirli zaman aralıklarında tahrir edilmiş ve bu tahrir sonuçları ayrıntılı şekilde mufassal defterlere yazılmıştır. Mufassal tahrir defterlerine Bitlis ve çevresinde bulunan zâviye ve zâviye gelirleri, buralarda görev yapan görevliler ve aldıkları ücretler, zâviye vakıflarının menkul ve gayrimenkulleri ile bunlardan sağlanan yıllık gelirler de ayrıntılı şekilde kaydedilmiştir. Bu çalışmada 1540, 1556 ve 1571 yıllarında düzenlenen dört ayrı tahrir defteri incelenmiş ve bu defterlerde yer alan Bitlis ve yöresi zâviyeleri tespit edilmiş, tespit edilen zâviyelerin günümüze kadar varlığını devam ettirip ettiremedikleri ortaya konulmuştur. Böylece özelde Bitlis şehrinin dini ve sosyo-kültürel tarihinin ortaya çıkmasına genelde de kültür tarihine katkı sunulmaya çalışılmıştır.
Günümüzde Bulgaristan'ın kuzey-batısında, Tuna Nehri'nin güney tarafında yer alan Vidin şehri Osmanlı hâkimiyetinde olduğu süre boyunca genellikle serhat şehri konumundaydı. Bu özelliğinden dolayı şehirde yerleşik halkın büyük çoğunluğunu askeri sınıf mensupları oluşturmakta ve Müslüman nüfus ile gayrimüslim nüfus bir arada yaşamaktaydı. Vidin'in bir başka özelliği de Osmanlı egemenliğinde olduğu dönemde tutulmuş çok sayıda şer'iyye sicil defterine sahip olmasıdır.Bu çalışmada Bulgaristan Arşivi "Nationale Biblioteque"de bulunan ve 1700-1750 yılları arasını kapsayan 12 adet şer'iyye sicili kullanılarak gayrimüslim kadınların evlenme-nikâh, mehir-boşanma, kefalet, vasi ve nafaka tayini, alacakverecek, miras, alım-satım gibi çeşitli konularda kadı mahkemelerini kullanma pratiklerine örnekler verilerek, Osmanlı toplumunda gayrimüslim kadınların konumu ve cemaat mahkemeleri yerine Kadı mahkemelerini kullanma nedenleri ortaya konulmaya çalışılmıştır.
Bir toplumun maddi kültür unsurlarından olup örf, adet, gelenek ve göreneklerinin göstergelerinden olan eşya kültürü, tarihsel süreçte çeşitli etkenlere bağlı olarak toplumdan topluma gelişmiş ve değişmiştir. Kültürel, dinî ve coğrafi yapıya göre şekillenen ev ve ev içi eşyaların tespiti ile bunların detaylı incelenmesi toplumun kültürel ve ekonomik yapısını belirlemeye, bireylerin üretim-tüketim alışkanlıklarını, gündelik yaşamlarını ve yaşam standartlarını ortaya koymaya yardımcı olmaktadır. Bu çalışmada Makedonlar tarafından Bitola, Rumlar tarafından Monastirion, Sırplar tarafından Bitolj, Bulgarlar tarafından Bitolja, Yunanlılar tarafından Monastir veya Manastiryon, Türkler tarafından Manastır olarak anılan ve Makedonya’nın güneybatısında Pelister Dağı eteğinde, Pelagonia Ovası’nın güneybatı sınırında, Ege’den Adriyatik’e uzanan ve Roma döneminde, Roma ve Konstantinopolis’i birbirine bağlayan Via Egnatia adlı doğu-batı ticaret yolunun ortasında bulunan Manastır’da 1700-1730 yılları arasında kadınların gündelik yaşamlarında kullandıkları araç-gereçlerin neler olduğu ele alınmıştır. Çalışmanın ana kaynakları 1700-1730 yılları arasında Manastır Mahkemesinde tutulmuş 14 adet şer‘iyye sicil defterlerinde dağınık hâlde bulunan 98 adet kadın terekesidir. Üçü gayrimüslim olan bu kadın terekeleri gözden geçirilmiş ve bunlardan hareketle kadınlar tarafından gündelik yaşamda kullanılan araç-gereçlerin neler olduğu, hangi malzemelerden yapıldıkları ve fiyatları tespit edilmiş, bunların kadınların toplumsal konumlarına ve sahip oldukları servet miktarlarına göre değişip değişmediği irdelenmiştir.
The Ottoman State contains many different ethnic elements which constituted a legal perspective. In this regard, the necessary precautions were taken to ensure that Muslims and non-Muslims live together peacefully in Vidin, a border city that was very important for the Western military expeditions of the Ottoman State known as "dār al-jihad wa-l-mujāhidīn" during the 18th century which set a historical example. The economic and social dimensions of the relations between the Muslim and non-Muslim population comprising the society in Vidin who have shared the same city, neighborhood and public space during 1700-1750 were examined in this study and the conflicting subjects with regard to the ongoing relations between these two communities were tried to be determined. A total of 15 shari'a registries kept by the qāḍī (Muslim Judge) court for the related period located at the Oriental Department of National Library of Bulgaria constitute the main resources of the study. The shari'a registries that are the main resources of urban historical studies are full of countless examples that provide information on the relations between Muslims and non-Muslims in Vidin. The examination of these examples is of significant importance for putting forth the methods with which the nation system is applied by the Ottoman Empire as well as their opinions towards the non-Muslims they rule.Summary: Vidin, located today in northwest Bulgaria was founded during the 1 st century BC to the right of the River Danube by the Romans and named as Bononia. This settlement which was named as V'din by the Muslims throughout the Middle Ages was transformed into a castle about 800 years after its foundation. The city that continuously changed hands due to its location at the border fell under the Ottoman rule after Battle of Nicopolis dated 1396. Vidin became one of the important border cities of the Ottoman against Serbia, Walachia and Hungary until the beginning of the 16 th century. This importance of Vidin gradually decreased after the Ottoman Empire conquered Belgrade, Budin and Timişoara. Vidin retrieved its status as a border city against the Hungarians and the Wallachians after the Habsburgs dominated the region following the Great Turkish Wars that took place during 1683-1699, and thus regained its past importance. Even though the pressure influenced Vidin as a result disappeared with the 1739 Treaty of Belgrade, the conflicts between Austria and the Ottoman Empire did not end completely and continued throughout the 18 th century. Vidin preserved its status as a first-degree border city for the Ottomans during the period of time, as examined in this study, which was also known as "dār al-jihad wal-mujāhidīn" starting from the beginning of the new century.Majority of the settled public were comprised of military classes in Vidin due to its geographical location where the Muslims and non-Muslims lived together.
