Résumé Malgré la décentralisation de compétences dans les domaines de l’urbanisme et l’aménagement du territoire, ceux‑ci restent des domaines de compétence partagée. Les réformes du droit de l’urbanisme ont sans cesse élargi son objet. L’émiettement communal français a eu pour conséquence qu’il aura fallu vingt ans pour que s’impose l’idée que l’urbanisme nécessite une échelle intercommunale. Mais la loi n’est pas encore allée au bout de sa mise en œuvre. La loi NOTRe dote la région d’un outil de planification réglementaire, ayant vocation à intégrer diverses planifications sectorielles, et opposables aux documents d’urbanisme. Mais l’expérience des anciens schémas régionaux d’aménagement et développement (SRADT), le redécoupage des régions et la montée en puissance des métropoles ne permettent pas d’anticiper l’usage que les régions feront de ces nouveaux pouvoirs.
Résumé Le droit de l’environnement s’est constitué, à l’origine, comme une addition de polices spéciales visant à prévenir par la réglementation, l’autorisation et la sanction les atteintes au milieu naturel. La prise en compte de l’objectif du développement durable conduit à recourir à de nouveaux instruments reposant davantage sur le contrat, la concertation et les mécanismes économiques et financiers.
