Ce concept est relatif à la prise en compte juridique — à l'institutionnalisation — des dimensions concrètes de la personnalité humaine, fondée sur une dynamique d'autonomie individuelle et de protection vis à vis des contraintes sociales. Sa portée, à la fois subjective et objective, et la diversité de ses effets lui confèrent une fonction « matricielle ». La notion française de liberté personnelle s'inscrit, dans son principe, dans cet ensemble.
