This paper aims to demonstrate how the field of disability studies consolidated the concept of disability as social oppression. By reviewing the main ideas of the social model of disability, this article presents the genesis of the concept of disability as a restriction of participation for disabled people, as adopted by the United Nations Convention on the Rights of Persons with Disabilities, which Brazil ratified in 2008.
Os estudos internacionais sobre deficiência são um campo consolidado nas ciências sociais, embora no Brasil seja incipiente e frágil. O conceito de deficiência diz respeito às restrições sociais impostas às pessoas que possuem variedade nas habilidades corporais. O objetivo deste artigo é analisar o debate sobre deficiência a partir de dois enfoques: 1) compreender a deficiência como uma manifestação da diversidade humana, partindo da análise do debate do modelo social da deficiência - uma corrente política e teórica que reconhece a deficiência como opressão sofrida pelas pessoas com lesões em ambientes sociais pouco adaptados às diversidades corporais; 2) demonstrar que a mudança na compreensão do corpo com deficiência como manifestação da diversidade corporal traz melhores instrumentos para o modo como a sociedade deve se organizar para promover justiça às pessoas com deficiência, promovendo a garantia dos direitos de cidadania dessas pessoas que representam 14,5% da população brasileira, segundo o último Censo de 2000.
Resumo O artigo discute os principais avanços e desafios em avaliar a deficiência como restrição de participação social. Essa nova compreensão é oriunda da Classificação Internacional de Funcionalidade, Incapacidade e Saúde – CIF da OMS de 2001, da Convenção sobre os Direitos das Pessoas com Deficiência da ONU de 2006 e, mais recentemente, da Lei Brasileira de Inclusão – LBI, de 2015, conhecida também como Estatuto da Pessoa com Deficiência. A mudança de compreensão sobre a deficiência de uma perspectiva meramente biomédica, para uma compreensão como desigualdade social reforça a ideia da deficiência não como atributo individual, mas como resultado de uma sociedade despreparada para a diversidade humana. A partir de uma análise documental do marco legislativo sobre as políticas para as pessoas com deficiência, sobretudo, da LBI e das avaliações da deficiência que já utilizam a CIF no país, o argumento defendido é o de que classificar e valorar a deficiência nessa perspectiva é desafiante para profissionais avaliadores e para as políticas públicas brasileiras. Principalmente, devido aos desafios para apreciar as barreiras e os fatores ambientais que impedem a plena participação das pessoas com deficiência na sociedade.
Deficiência e BPC: o que muda na vida das pessoas atendidas?
Resumo: Introdução: A inclusão no mundo do trabalho é um dos principais desafios contemporâneos em promover os direitos humanos das pessoas com deficiência em qualquer país. Objetivo: Realizar uma discussão teórica e de análise de política pública através das características do marco legislativo dos países latino-americanos com suas respectivas iniciativas, políticas e programas para promover a inclusão laboral de pessoas com deficiência. Método: Os documentos foram analisados, com ênfase na análise de conteúdo, a fim de conformar um quadro de análise sobre as principais características, semelhanças e desafios enfrentados por esses países. Resultados: As principais iniciativas dos países latino-americanos têm sido: 1. aprovação de legislações com obrigatoriedade de reservas de vagas nas empresas e serviço público, 2. criação de sistemas nacionais informatizados de intermediação de mão de obra, 3. programas de incentivo ao empreendedorismo de pessoas com deficiência e 4. políticas de acompanhamento personalizado do itinerário de inclusão laboral. Conclusão: Os principais desafios comuns aos países latino-americanos, que se transformam em barreiras à inclusão, são: 1. Cumprir as cotas reservadas e efetivar a fiscalização, 2. Aumentar a qualificação educacional e profissional das pessoas, 3. Compatibilizar rendas de benefícios não contributivos/assistenciais com rendimentos do trabalho, 4. Sensibilizar as empresas, famílias e sociedade sobre a produtividade e capacidades das pessoas com deficiência e 5. Criar isenções fiscais e demais incentivos às empresas para a contratação de pessoas com deficiência. Overall, this mapping exercise showed that applying the International Classification of Functioning, Disability and Health linking rules to population-based data coming from different sources provides researchers and stakeholders involved in decision-making with standardized and straightforward information about overlaps and gaps. Implications for Rehabilitation Data on functioning and disability regularly collected with different purposes and by different institutions or ministries within a country can be compared using the International Classification of Functioning, Disability and Health as a reference framework and the International Classification of Functioning, Disability and Health linking rules. The recently published refinements of the International Classification of Functioning, Disability and Health Linking Rules go beyond the sole linking to International Classification of Functioning, Disability and Health categories and provide standardized procedures to document the perspective of linked questions or the categorization of response options. They are therefore useful to compared tools that have been developed based on the International Classification of Functioning, Disability and Health. The current disability module of the Brazilian Health Survey needs a revision to be suitable to collect data on disability that is Convention on the Rights of Persons with Disabilities conform and guarantees interoperability with disability data from other sources in Brazil, especially from disability assessment for social benefits and implementation of policies.

ABSTRACT -It analyzes the contemporary configuration of social assistance policy to investigate how the state and the families share responsibility provision to basic needs of individuals and to combat deprivation and social risks. Through genealogical method, a documentary analysis of the laws was made, decrees and other regulations of social assistance policy to develop subsidies for discussion. It argues that assistance lifted to the status of social security policy from 1988 through the structuring of a familist circuit complex, whose responsibilities to combat deprivation, vulnerability and social risks of the citizens are shared between the state and families, or are still transferred legally to families or fully assumed by them when there is state failure.
