This paper describes the historical development and profile of Continuous Cash Benefit (BPC) applicants, intended for poor elderly and people with disabilities, which, since 2009, uses eligibility criteria based on the International Classification of Functioning, Disability and Health (ICF) of the WHO and is aligned with the UN Convention on the Rights of Persons with Disabilities. The behavior of benefits was determined from the analysis the coefficients of the general and non-judicial grants between 1998 and 2014. The profile was established for the years 2010 and 2014 according to situation of acceptance, age, gender and ICF components. The average annual growth of the coefficient was higher from 2000 to 2010, prior to the adoption of the biopsychosocial eligibility model, and the coefficient of non-judicial grants increased until 2010, falling thereafter. The deferrals acceptance /rejections ratio was higher among children and among those facing severe or total environmental barriers, limitations, constraints and bodily changes. The implementation of the biopsychosocial evaluation model did not cause an increased rate of grants and results evidence the need for flexibility in the eligibility criteria.

Background: In Brazil, there are 55 million people living in extreme poverty. People with disabilities are doubly impacted by low income and the presence of the disability. The Continuous Cash Benefit Program (BPC) is an aid granted by the Brazilian federal government to people who attest to the condition of disability as an impediment to a life on an equal basis with other individuals. Requests to BPC are made to the national competence body that carries out an expert medical and social assessment, by means of an instrument that determines the degree of the disability. Our objective was to analyse the standard of BPC concessions for children and young people with disabilities and to identify the prevalence of major diseases in the concessions. Methods:The exploratory, cross-sectional and retrospective research used primary data collected from 332 expert medical assessments of children under 16 years old.The standard and determinants of the concessions were established through Cluster Analysis by Ward's criterion and Euclidean distance, specifying the homogeneous groups of dysfunction classes. The prevalence of major diseases was performed by frequency analysis according to the International Classification of Diseases (ICD). The socioeconomic profile of BPC requirements and the main causes of BPC rejection were analysed through descriptive analysis.Results: There was a predominance of male, preschoolers and illiterate individuals in the requirements and concessions. In the granting standard for impaired function class, problems related to congenital changes received benefits even in the absence of impairment, with childhood autism being the most prevalent diagnosis. Conclusions:The concessions seemed more dependent on the diagnosis itself and on the age of the beneficiaries than on the degree of dysfunction suffered, without exclusions, by the individuals.

A situação de deficiência, como expressão das desigualdades sociais, demanda perspectivas e tratamentos singulares. Em face dessa premissa, o presente artigo tem o escopo de pautar e discutir acerca de aspectos da dignidade humana trazidos a lume pela Convenção sobre os Direitos das Pessoas com Deficiência (ONU, 2006), instrumento jurídico internacional que funciona como espécie de arauto dos direitos humanos mais consentâneos com a realidade de tais pessoas, no século XXI. Nessa direção, faz-se uso de contribuições argumentativas de doutrinadores e fundamentações notoriamente consistentes, tanto do ponto de vista fático quanto, e principalmente, da realidade jurídica. Tomada como núcleo fundante das Constituições dos Estados Democráticos e Sociais de Direito contemporâneos, a dignidade humana constitui verdadeiro valor que irradia seus efeitos para exigir ações prestacionais do Estado em relação aos seus cidadãos. Como premissa da nova ordem constitucional, a dignidade humana é dotada de elevada carga axiológica aberta, daí sua primazia como paradigma e referencial ético frente à diversidade humana representada pelas pessoas com deficiência. Nesse cenário, a aludida Convenção deve constituir-se em instrumento realmente efetivo para o destacado fim de reconhecimento, proteção e materialização da dignidade humana de que as pessoas com deficiência são titulares, instando os Poderes Públicos a promoverem condições materiais suficientes para garantir a concretização dos ideais constitucionais, dentre eles o respeito à própria dignidade humana e a inclusão social de tais pessoas.
