Este estudo qualitativo, de caráter exploratório e descritivo, foi realizado junto de crianças vítimas de violência doméstica e teve como objetivo geral compreender como aquelas percecionam o facto de serem ou não ouvidas no âmbito dos processos em que estão envolvidas. A amostra intencional foi composta por dez crianças portuguesas, com idades entre os sete e os 17 anos, de ambos os sexos, que se encontravam acolhidas com as suas mães em casa de abrigo para vítimas de violência doméstica há pelo menos um mês. Os dados foram recolhidos através de entrevista semiestruturada, previamente testada. Da análise do conteúdo das respostas salienta-se a emergência de duas categorias, 'auscultação da criança pelos adultos' e 'participação em tribunal', com base nas quais se discute a importância da escuta da opinião da criança, ajudando na compreensão de como esta pensa e sente determinadas questões e como pode contribuir para a resolução de certos problemas. A maioria das crianças deseja poder expressar perante o magistrado algumas das suas necessidades, sendo uma delas a garantia de segurança, através do afastamento do agressor. Discute-se com base nestes resultados qualitativos a relevância da participação da criança em decisões da justiça. Palavras-chave:Crianças, Violência, Justiça, Direitos, Participação. IntroduçãoO reconhecimento social da criança como sujeito de direitos está contemplado em diversos diplomas legais internacionais (Anderson, 2000), que alguns Estados foram ratificando. Em Portugal, as alterações legislativas ocorridas nos últimos anos (cf. Gonçalves & Sani, 2013) foram permitindo o debate público e académico a respeito da participação da criança em vários domínios, sendo particularmente acesa a discussão sobre a posição da criança perante o sistema de justiça. A este nível, o acesso da criança à justiça e, em particular, o direito de ser ouvida em assuntos de particular importância na sua vida, decorre, em muito, do modo com cada sociedade perceciona a infância (Sani, 2013), podendo em algumas situações complexas (e.g., adoção, divórcio, separação, violência) ser ou não ouvida. Todavia, alterações na legislação portuguesa no regime geral do processo tutelar cível (Lei n.º 141/2015, de 08 de Setembro) veio estabelecer que as autoridades judiciárias têm de realizar a audição da criança, devendo a sua opinião ser tida em consideração na determinação do seu interesse. Vários outros documentos (e.g., Convenção dos Direitos da Crianças; Diretrizes do Comité de Ministros do Conselho da Europa sobre a justiça) têm firmado que a criança tem o direito de exprimir a sua opinião, devendo ser assegurada a oportunidade de ser ouvida em processos judiciais e administrativos que lhe dizem respeito (Conselho da Europa, 2013;UNICEF, 2004). 487A correspondência relativa a este artigo deverá ser enviada para:
