Like others, German anti-discrimination law is based on a closed list of grounds for discrimination, (gender, race and religion). Moreover, these grounds are embedded within a complicated hierarchy of legal protection. Through this lense, legal actors face substantial risks: homogenizing intersectional experiences of discrimination, essentialising grounds for discrimination, and excluding outlier persons or experiencing multidimensional forms of discrimination apart from legal protection. After reviewing the history, advantages and 'collaterals' of the categorical approach, this article shows that the prevalent German legal doctrine cannot adequately grasp multidimensional discrimination. Therefore the article suggests the adoption of a non-hierarchical post-categorical approach. This might help to draw attention from special groups and individuals to processes of social classification, stigmatization and subordination, then increase our awareness for the problems of intersectionality in legal discourse. 1.
