Die vorliegende Biographie widmet sich dem bewegten Leben Hans Kelsens, des wohl bedeutendsten Rechtsphilosophen des 20. Jahrhunderts. Sein Lebensweg führte ihn von Prag und Wien über Köln, Genf und andere Stationen bis nach Berkeley in Kalifornien. In ihm spiegeln sich die letzten Jahre der Habsburgermonarchie, der Antisemitismus und die Situation des assimilierten Judentums in der ersten Hälfte des 20. Jahrhunderts, der Erste Weltkrieg und der Zerfall der Monarchie wider, aber auch die Entwicklung des Austromarxismus, die Gründung der demokratischen Republik Österreich und ihr Zerbrechen an den antidemokratischen Kräften, die Machtergreifung der Nationalsozialisten in Deutschland, Österreich und der Tschechoslowakei, die schwierige Lage der Schweiz in der Zwischenkriegszeit, die Emigration europäischer Intellektueller nach Amerika, der Eintritt der USA in den Zweiten Weltkrieg, die Nürnberger Kriegsverbrecherprozesse und die Neugestaltung Mitteleuropas nach dem Krieg, schließlich der Aufstieg der Universität Berkeley zu einer der führenden der Welt. Vor diesem Hintergrund entwickelte Kelsen seine Reine Rechtslehre, ein rechtstheoretisches Modell, das sich zum Ziel setzte, die Rechtswissenschaft von aller politischen Ideologie und allen naturwissenschaftlichen Elementen zu reinigen und den Idealen der Objektivität und Exaktheit soweit als möglich anzunähern. Für dieses Bemühen erlangte Kelsen Weltruhm. Kelsen war aber auch ein bedeutender Demokratietheoretiker; er war »Architekt« des Bundes-Verfassungsgesetzes von 1920, das bis heute in Österreich in Geltung steht.
At Austrian universities, the problem of 'Precedence of Constitution' is usually taught within the framework of the 'theory of the hierarchical structure of the legal order', an essential part of the so-called 'Pure Theory of Law.' Whilst the famous jurist Hans Kelsen (1881-1973) was the founder of the Pure Theory, the 'theory of the hierarchical structure' has been introduced by Kelsen's disciple Adolf J. Merkl (1890-1970) in 1918 and is accepted also by those who do not follow Kelsen's Pure Theory. According to the Pure Theory, the basis of the validity of a norm can only be another norm, which can be seen as the 'higher' norm. The legal order can be seen as a structure of 'higher' and 'lower' norms, and within the legal order of a certain state, its constitution is the highest norm of all-the 'paramount law', as has been said by US Supreme Court in its famous case Marbury v. Madison, in 1803. The 'theory of the hierarchical structure' also gives the justification for constitutional justice: the constitutional court reviews whether the legislator has remained within the framework of the constitution. 'Precedence of Constitution' or, in German, Verfassungsvorrang, the phrase which is in the centre of this conference, is hardly ever used in the Austrian legal language, even almost unknown. The problem discussed here, which is the question of the relationship of the constitution to other norms, in particular to statutes, is usually taught at Austrian universities within the framework of the 'theory of the hierarchical structure of the legal order'-in German: Lehre vom Stufenbau der Rechtsordnung.
So it seems that the first steps of his career were very difficult for him and only the political circumstances-the collapse of the monarchy and the rising of the republic in 1918-enabled the further steps. This article, however, shows that Kelsen was in discussion for a professorship even earlier, in 1916 at the University of Graz and soon after that in Czernowitz, before he was appointed at the University of Vienna. It gives a panorama view of the situation of the public law in Austria at the beginning of the 20 th century.
