RÉSUMÉ
Voulant contribuer à l'histoire de la « folie » au Québec, cet article met à profit les riches possibilités offertes par des archives judiciaires, les dossiers d'interdiction et de curatelle, pour souligner le rôle de l'instance familiale et communautaire dans la prise en charge et l'exclusion de la maladie mentale au tournant du siècle. À l'aide des mesures réglant l'incapacité de majeurs considérés mentalement déviants, on peut identifier quelques données importantes de l'expérience de l'aliénation mentale de plusieurs dizaines d'individus des Cantons de l'Est. Des particularités sociologiques ou juridiques pouvaient influencer le passage d'une personne devant la justice civile, et l'examen des infractions aux normes dénoncées dans les dossiers permet de cerner les préoccupations des membres de la famille et de l'entourage. Ceux-ci, placés en première ligne, devaient recourir à des stratégies particulières, y compris l'appel à la justice, pour gérer la conduite d'un individu aux comportements hors normes. Enfin, même si on faisait largement appel à l'avis des médecins et des aliénistes lors des procès, l'expertise des médecins de la région, en ce qui a trait à la maladie mentale, paraît douteuse. L'analyse conduit à remettre en question l'utilité générale de la perspective voulant que la réponse à la folie ait été essentiellement, au XIXe et au début du XXe siècles, une entreprise institutionnelle de contrôle social menée par les élites bourgeoises, médicales et étatiques.
Au début du XXe siècle, la situation financière des femmes mariées de la bourgeoisie québécoise pouvait être mise à l’épreuve lorsque des obligations contractées dans l’espace public engendraient saisies, faillites ou états de gêne. Les contrats de mariage prévoyant une séparation de biens entre les conjoints et des donations au profit des épouses étaient destinés à les mettre à l’abri en cas de problèmes du genre. À partir de l’analyse de procès rapportés par la jurisprudence, cet article tente de soupeser l’efficacité concrète de ces pratiques sociojuridiques. Si certaines femmes réussissaient à faire prévaloir la protection de leurs biens et à faire reconnaître les promesses qui leur avaient été faites en contrat de mariage, leur condition se révélait en général assez fragile en cas de litige. Cette fragilité était accentuée par leur condition juridique inférieure, qui rendait leur participation aux procédures parfois problématique, par l’indécision des tribunaux de la province quant à l’interprétation à donner à certaines clauses des contrats de mariage ainsi que par la mission assez malaisée des magistrats qui devaient protéger de concert épouses et créanciers des ménages.
Résumé
Nous proposons ici une lecture particulière de l’expérience bourgeoise, en mettant l’accent sur les effets sociologiques et relationnels du patrimoine familial. Les archives privées d’une des plus riches lignées canadiennes-françaises du xixe siècle, les Masson, montrent qu’une succession importante était susceptible d’influencer de manière déterminante le rang social et l’occupation d’héritiers mâles, ainsi que les rapports intrafamiliaux. Cette trajectoire spécifique est marquée, du milieu du xixe siècle aux premières décennies du xxe siècle, par la présence d’héritiers « ratés », successeurs oisifs, endettés ou aux destins marquant un sensible déclassement social. Aussi, la gestion et les profits à tirer de l’opulente succession de Joseph Masson ont suscité de fortes tensions interpersonnelles et des poursuites judiciaires entre apparentés. Certains héritiers ont notamment été marginalisés, puisque leurs proches les jugeaient peu compétents en regard d’un univers financier de plus en plus complexe au début du xxe siècle.
Cette étude financière de la vie privée montre en fin de compte que des rapports familiaux pouvaient se dérouler à une distance sensible de certaines données essentielles de la transition au capitalisme comme la valorisation de l’individu entrepreneur et de l’idéologie contractuelle. Et, surtout, à la différence de la perspective « stratégique », elle met en lumière les tensions, blocages et éventuelles défaites des acteurs du passé, sans miser implicitement sur la cohérence, la spontanéité des réponses fournies par ces mêmes acteurs à la situation qui était la leur.
