Aussi, bien que la Convention soit considérée comme un instrument juridique international à vocation universelle faisant foi, conformément au principe d'égale authenticité des versions traduites (Sauron, 2009), les conditions d'appropriation du texte par les citoyens arabes semblent insuffisantes. Au niveau formel, on remarque que l'orientation qui a été prise d'une uniformisation phraséologique et terminologique par un processus de superposition du texte traduit aux textes sources anglais et français -l' objectif étant de conserver une neutralité du discours -contribue à créer un style en rupture avec les habitudes langagières et le lexique partagés par les locuteurs natifs. Au niveau du traitement des concepts, on observe un décalage référentiel suscité par certains choix dénominatifs qui, dans le cadre de systèmes et pratiques juridiques propres aux pays arabes, renvoient à des normes et principes de droit parfois très différents. Mots-clés : enfant, droit international, droit musulman, traductologie, traduction AbstractThis article aims to highlight the contradiction between the fact that the Convention on the Rights of the Child is supposed to be addressed to all those able to understand it ("à tout entendeur"; Cornu, 2005, p. 227-228) and yet the editorial constraints to which the text was submitted (De Saint Robert, 2013), make it difficult to interpret for the reader who is not a specialist of Onusian speak. This is why Arab citizens find the Convention difficult to appropriate, even though the translation is considered an 62 TTR XXIX 1 Sylvie Chraïbi authentic international juridical instrument with a universal vocation, in accordance with the principle of equal authenticity of the translated text (Sauron, 2009). At a formal level, we note that the tendency to standardize the phraseology and the terminology by a process of superposition of the translated versions with the original texts written in English and Frenchin order to respect the neutrality of a UN discourse-contributes to creating a style that marks a stark contrast with language habits and lexicon of native speakers. Dans cet article, nous nous interrogerons sur l'efficacité de la traduction vers l'arabe de la Convention internationale des droits de l'enfant. En effet, le texte introduit une terminologie de la protection de l'enfant qui met en évidence une rupture entre, d'une part, les idéaux édictés par les instances internationales et, d'autre part, les réalités sociales et culturelles du monde arabe. Il semble par conséquent d'une appropriation difficile, n'ayant d'ancrage ni dans la tradition lexicale ni dans le mode de représentation d'un certain ordre social. Nous rappellerons qu'à la fin du XIX e siècle, al-Tahtâwî avait déjà perçu, dans son célèbre traité d'éducation, qu'un projet d'implanter des concepts occidentaux dans un système culturel arabe devait s'inscrire dans une logique de continuité. Aussi s'est-il attaché à définir les transformations qu'il prônait en s'appuyant très souvent sur une terminologie ancienne, voire coranique. L'analyse d'articles récents extraits des médias arabes (Maroc et Égypte) sur la question du mariage forcé vient corroborer la position d'al-Tahtâwî: on voit en effet que la référence en matière de protection des mineurs sera davantage le cadre juridique local.
