<div><p>Trata-se de artigo que objetiva analisar a contribuição das políticas de <em>compliance<strong> </strong></em>para a promoção da necessária mudança cultural no abandono das heranças seculares racistas que permeiam a sociedade brasileira. Com efeito, busca-se abordar, inicialmente, o racismo estrutural, na perspectiva histórica e como está enraizado e se espraia nas relações sociais até os dias atuais. Em seguida, analisa-se o que são as políticas de <em>compliance</em>, desde sua origem, perpassando pela compreensão de que os programas de conformidade não se limitam às questões econômicas da pessoa jurídica, mas a todas as relações por ela travadas, sobretudo com seus <em>stakeholders</em>, para, ao final, questionar em que medida o <em>compliance </em>pode ser importante ferramenta na luta antirracista e na promoção da justiça social. Para tanto foi empregado o método hermenêutico, com a releitura de obras e artigos científicos, nacionais e estrangeiros, com abordagem qualitativa.</p><p> </p></div>
Resumo: O presente estudo versa sobre as políticas de compliance e a autoregulação regulada como ferramentas de prevenção à lavagem de dinheiro. Tem como objetivo principal verificar, à luz do novo panorama do Direito Penal, no viés da criminalidade econômica transnacional, se as políticas de compliance e a autorregulação regulada são ferramentas eficazes de prevenção e combate à lavagem de dinheiro. Nota-se que o Direito Penal está profundamente relacionado com as questões do estudo por proporcionar diretrizes que definem condições viáveis para o desenvolvimento de uma análise mais aprofundada, que por diferentes enfoques e perspectivas, consegue refletir sobre as hipóteses levantadas na pesquisa e a chegar às primeiras reflexões investigadas e considerações finais com segurança.
