This research aimed to find the formal genus of the value of justice in Indonesia. As known, justice that holds the sense of plurality universally transcends the boundary of formality of narrative texts in a normative way. The plurality of the value of justice that is laden with universality transforms to the genus of the school of thoughts vis-à-vis justice throughout history. Reduced meaning of justice in the perspective and the process of legislation is not powerful enough to negate the genus of justice that inherently represents the fundamental characteristics of justice. The look of the legislative process attractively reflects the genus of hunger for power intended to justify ambitions among factions in the domain of democracy. The formality in the legislation no longer represents the principle of the definition of the legislation and it is getting further away from the reach of the definition of aspiration, let alone to become an inspiration of the objectives of the state as mandated in the constitution. Holistic approach used in this research to find out the formal genus of justice in Indonesia. This research found that religious matters in the legislation-related authorities have become an acceptable ornament among the piles of the works of morality. The integrity that has become the genus of justice morality has transformed into a collection of texts hanging all over the wall of the national parliament. Religions are used as tools of negotiation in the formulation and the making of narrative texts before they are further transformed into legislation. Religions and powers in legislation are competing to find their point of the genus of normativization as expected by each faction. Law came into existence earlier than expected, leaving behind its umbilical cord like a prematurely born soul, the cord through which the values of justice are transferred from its mother, and these values have the dimension of plurality. Law is born, but since it is separable from its genus, it does not carry much of the meaning of birth.
<p>Corruption is a fact of life in Indonesia and has a significant negative impact. The malicious intention of corruption in Indonesia has normatively shifted in terms of its meaning, adjusting to its opportunity. However, the increase in corruption in Indonesia is not accompanied by a legal policy of anti-corruption supervisor design. This study analyzes the legal procedure of strengthening supervision for corruption prevention in realizing good governance. The results indicate that the derived meaning of malicious intention of corruption in the old order, new order, and reform era gradually reduces the significance of adversarial nature from the perspective of public morality and the state's ideology. The Corruption Eradication Commission has been given authority to prevent and prosecute criminal acts of corruption. Establishing anti-corruption institutions in the regions serves as an anti-corruption enforcement agency and a control and monitoring system for government administration in all agencies to achieve good governance.</p>
Korupsi bukan saja bermakna merugikan keuangan Negara atau perekonomian Negara secara kuantitatif, korupsi merupakan perbuatan yang bertentangan dengan hak konstitusionalitas warga Negara untuk mendapatkan pekerjaan yang layak bagi kemanusiaan dan penghidupan yang layak bagi kemanusiaan. Korupsi merupakan perbuatan yang merongrong ideologi bangsa sebagai landasan dan arah keberlangsungan peradaban bangsa. Korupsi merupakan perbuatan yang dapat disejajarkan dengan bughot (pemberontakan) terhadap sendi-sendi keteraturan Negara hukum. Putusan hakim perkara korupsi merupakan hukum yang konkrit dan langsung mengikat untuk mewujudkan tujuan luhur dalam pembentukan Negara. Putusan hakim perkara korupsi menjadi risalah sejarah dalam membangun peradaban umat manusia untuk hidup sejahtera, tertib, cerdas, dan adil secara utuh. Hukum yang baik (bersumber dari nilai moralitas) dan hukum yang benar (bersumber dari nilai konstitusionalitas), harus dan wajib menjadi paradigm dalam membangun grand design hukum yang dapat mencegah dan memberantas korupsi di Indonesia. Paradigma desain putusan hakim perkara korupsi di Indonesia harus simetris dengan konsep Negara hukum yang sebenarnya. Putusan hakim perkara korupsi hakekatnya merupakan wujud Negara hukum yang mensejahterahkan rakyatnya. Putusan hakim perkara korupsi yang menjamin kepastian hukum yang adil sebagai wujud ketertiban dan keteraturan dalam tata kelola pemerintahan yang baik dan benar. Putusan hakim perkara korupsi yang menjamin kepastian hukum yang adil mempunyai kekuatan sebagai alat centripetal dan centrifugal dalam mewujudkan keadilan social bagi seluruh rakyat Indonesia.Kata Kunci : hukum, korupsi, baik, benar
Working is not only for the sake of earning money, nor is it for the sake of fitting professional rationality. It goes beyond what it appears to be; it represents observances of God. That is, occupations should be seen from a wider perspective implying that it also considers spiritual, immaterial, and material dimensions. The spiritual scope represents the responsibility of humans to their God; the material scope is understood as working for a family, society, the state, and the nation. An occupation carries the spiritual value that represents the social behavior of bearing the responsibility for a job. Mental and social aspects in an occupation carry another meaning of social justice for all Indonesian laborers. Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation, apart from pushing and urging attitude calling for its formulation and pragmatic needs that remain problematic in the eye of society in general, needs testing and reviewing fundamentally from the perspective of social justice principle for all Indonesian laborers. This study is focused on the analysis of the substance of Government Regulation in Lieu of law concerning Job Creation seen from the perspective of social justice for all the workers concerned. This study employs philosophical, conceptual, and statutory approaches to delve into the typical principle of justice in Government Regulation in Lieu of Law concerning Job Creation.
The most obvious shift in the order of interactions and values in social interactions after the reform era is the issue of appropriateness and appropriateness of values and interactions in family-household (private-domestic) affairs. However, after the reform era, the values and interactions in a family or household have been distorted by the state authorities into public affair and are no longer a private (domestic) affair. The fundamental problem of law enforcement lies in the conception of harmonizing the relationship of values. In the context of law enforcement related to domestic violence, the harmonization of the values that form the basis of the interaction system and the values that underlie a household with the values established in the formal state law, namely Law No. 23 of 2004 concerning the Elimination of Domestic Violence. The basic problem that occurs is the misalignment of the implementation of legal politics, the values that are the basis of household building as stated in the PKDRT Law, do not originate from religious moral values.
