Ludwig, Duke of Bavaria, who was elected as the king by the majority of German electors for the vacant imperial throne in 1314, was crowned Holy Roman German Emperor in Aachen without waiting for the approval of the papal office. In the face of this situation, Pope Johannes XXII warned Ludwig to give up his imperial claim and excommunicated him after he ignored this warning.Ludwig's answer to this was to organize an expedition to Italy instead of stepping back, and to try to dominate the imperial power there. In addition, Ludwig tried to eliminate the intervention of the papacy in the worldly sphere by declaring that the empire was based on elections, not the approval of the pope, with the laws he enacted. The article tried to deal with the power struggle of the Holy Roman German Emperor Ludwig IV and Pope Johannes XXII, who set a sample for the pope-emperor conflict in the middle ages, together with its causes and consequences, and tried to shed light on all aspects of this struggle in the light of the sources of the period and modern studies.

Ancak insanlık tarihi boyuca çoğunluğu sömüren küçük bir azınlığın müdahalesiyle tüm bireylerin bu haklara eşit derecede sahip olması engellenmiştir. Orta Çağ Avrupa’sı siyasi, sosyo-ekonomik ve dini yapısı itibariyle bu durumun en iyi gözlemlendiği dönemdir. Özellikle Orta Çağ’a hakim olan feodal sistem ve Kilise, Orta Çağ insanının en temel haklarına ulaşmasını engelleyen bir yapı üzerine kurulmuştur. Bu bakımdan insanın; tanrı, toplum yahut devletten bağımsız olarak evrensel insan haklarına kavuşması modern bir düşüncedir. Orta Çağ’ın kurumlarına karşı verilen mücadelenin bir sonucu olarak ortaya çıkmıştır. Çalışma Orta Çağ Avrupa’sında insan haklarının durumunu değerlendirmeyi amaçlamaktadır. Ancak dönemin genişliği ve insan hakları çerçevesinin net bir şeklide çizilememesi nedeniyle en görünür hak ihlallerine işaret etmekle yetinilmiştir. Modern insanın uzlaşısı (büyük oranda) sonucunda oluşturulan Evrensel İnsan Hakları Bildirgesi’nin tanımladığı insan hakları bağlamında örneklendirmelere yer verilmiştir. Buna göre; özgürlük ve eşitlik gibi temel hakların feodal sistemde, düşünce ve inanç özgürlüğünün ise Kilise kurumu karşısındaki durumu karşılaştırılarak değerlendirilmiştir.
Avrupa edebiyatına konu olmuş Yahudi tipleri düşünüldüğünde akla ilk olarak olumsuz nitelikleriyle meşhur olmuş örnekler gelmektedir. Bunda, başta Ortaçağ olmak üzere, çeşitli dönemlerde Avrupa toplumunun Yahudilere yönelik olumsuz bakış açısının etkili olduğu söylenebilir. Yahudilere yönelik dini önyargı ve ayırımcılık yalnızca sözlü edebiyatta değil, Yahudi'yi şeytanla ilişkilendiren Ortaçağdan, "Tefeci Yahudi" karakterine vurgu yapan modern döneme değin, yazılı edebiyatta da etkisini sürdürmüştür. Buna göre efsanevi kötü Yahudi tiplemesinin modern edebiyatta yer alan olumsuz Yahudi konusu ve imajları üzerindeki etkisi açıkça görülmektedir. Batı edebiyatının genelini göz önünde bulunduracak şekilde, standart bir Yahudi tipinden bahsetmek mümkün olmasa da Shakespeare, Marlow, Schiller ve Dickens gibi Alman ve İngiliz edebiyatının meşhur isimlerinin eserleri üzerinden zor da olsa bir çıkarım yapılabilir. Olumsuz nitelikleriyle benzerlik arz eden bu Yahudi tiplerinin yaratılma sürecinde yazarların tarihsel, sosyal ve politik bağlamlardan bağımsız olmadığı çok açıktır. Bu bağlamda çalışma, incelenen eserlerin oluştukları dönemin koşullarını dikkate alan tarihsel bir yöntemle edebiyata yansıyan Yahudi karakterini incelemeyi amaçlamaktadır.
