AbstrakPengelolaan sampah saat ini masih menjadi permasalahan yang belum terselesaikan. Penelitian ini bertujuan untuk mengkaji permasalahan dalam pengelolaan sampah di Surakarta. Penelitian ini adalah penelitian hukum doktrinal/normatif dengan pendekatan perundang-undangan. Data dikumpulkan dengan studi kepustakaan, kemudian dianalisis secara kualitatif. Terdapat beberapa peraturan perundang-undangan yang mempunyai korelasi dengan pengelolaan sampah di Indonesia yaitu Undang-Undang No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup dan beberapa undang-undang lainnya. Penegakan hukum dalam pengelolaan sampah mengacu pada 3 sistem hukum yang merupakan gabungan dari komponen-komponen yaitu struktur, substansi, dan budaya. Selain itu berkaitan dengan penegakan hukum dalam pengelolaan sampah dapat dikaji dari 2 sisi yaitu penegakan hukum secara preventif dan represif. Penegakan hukum dalam pengelolaan sampah juga menjadi sebuah perwujudan pemerintah maupun pemerintah daerah dalam menerapkan prinsip Good Environmental Governance dengan tujuan akan menumbuhkan kesadaran bagi masyarakat akan lingkungan hidup yang baik dan sehat. <h3>Abstract</h3> <p><em>Waste management still be a problems which not yet solved. This research aims to study the problems in waste management in Surakarta. It was a doctrinal/normative legal research using the statute approach, which then analyzed qualitatively. There are laws correlated to waste management in Indonesia, they are Law number 18 Year 2008 on Waste Management, Law No. 32 of 2009 on the Protection and Environmental Management, and some more. The law enforcement in waste management refers to as known as legal system i.e. structure, substance, and culture. There are two kinds of waste management law enforcement; preventive and repressive way. The effectiveness on the enforcement refers to the combination of structure, substance, and law cultures of the community. This study discussing about the factors that causing the emergence of a double certificate and how agrarian law in Indonesia provides legal permission for certificate of land rights holder. This research is a normative legal research that acts prescriptive. The approach that used in this research are case reporting (case approach) and accessing the law (statute approach). Sources of data obtained from primary, secondary and tertiary legal materials. From the research results it is known that the factors of double certificate are inaccuracy of National Land Agency in the process of certificates issuance. Double certificate causes legal uncertainty for holders of land rights, thus potentially causing disputes in the future which also causing loss for both of holders. Legal protection obtained by the holders of land rights that are harmed because of the existence of double certificate are cancellation and revocation of related documents that are considered harmful by National Land Agency.
<p><em>The Act No. 16 year 1964 on Fisheries harvest-sharing regulated the policy of harvest-sharing on fisheries products in order to improve the welfare of the fishermen. However, the regulation seems to not running well, especially in Muncar District Banyuwangi Regency, where the fishermen were not familiar with the regulation and had their own customs on fisheries harvest-sharing which come across generations. This writing was applying the empirical legal study. The instruments were structured field interview towards fishermen, boat owner, and local government officials, which supported by literature review. Analysis was carried out by interactive model. This study found that the national regulation was unrecognized among the local fishermen and the harvest-sharing policy was based on their local customs. The harvest- sharing policy mostly was determined by the boat owner without former agreement. Therefore, the local government should supervise the application of the national regulation on harvest-sharing policy in order to improve the welfare status of the local fishermen. In addition, the ultimate social justice for the community will then be achieved.</em><em></em></p>
