Resumo O artigo versa sobre a equidade, a qual é entendida como recurso do intérprete contra a lei e o precedente. A partir da investigação de textos doutrinários, de decisões judiciais e de normas do direito brasileiro, a equidade é apresentada sob duas perspectivas, a casualista e a abstracionista. Analisa-se a vertente casualista, indicando e exemplificando as hipóteses em que as Cortes do país aplicam-na. Alguns precedentes do STF demonstram que a equidade pode ser mais iníqua que as decisões tradicionais. No entanto, argumentos conduzidos de maneira imparcial, justificáveis publicamente, podem melhorar a qualidade do julgamento por equidade, tornando-o mais razoável para a solução de casos difíceis. Há várias formas de empreender argumentos razoáveis para formar convencimento, a exemplo da retórica, mas as limitações argumentativas devem ser reconhecidas. Apesar das limitações da vertente casualista, o esforço por ela exigido é indispensável, na medida em que pode possibilitar a melhor solução para casos difíceis que não seriam resolvidos pelas regras e precedentes já conhecidos.
Resumo O artigo versa sobre a justificação e a formulação de um procedimento razoável que oriente julgamentos equitativos. A equidade é o recurso do intérprete contra a lei e o precedente, quando estes produzem respostas iníquas. Ante o risco de a equidade produzir arbitrariedades, o artigo investigou a possibilidade de se justificar, constituir e exemplificar a aplicação de um procedimento razoável para o julgamento equitativo a partir da vertente abstracionista, na tentativa de se reduzir a discricionariedade do intérprete. A metodologia consistiu na análise empírica de precedentes do STF que aplicaram princípios de algumas teorias da justiça, a partir dos quais se introduziu o conceito de "razoabilidade" de Jonh Rawls para, então, formular-se um procedimento que identifique a teoria da justiça que oferece uma solução ao caso concreto, oportunizando-se a análise de teorias concorrentes, após o que deverá encontrar-se pontos de congruência, excluindo-se os argumentos que incorrem em desintegração ou hiperintegração constitucional (teste de delimitação). Em seguida deve-se avaliar o grau de imparcialidade e razoabilidade da proposição por meio dos testes de justificação, confrontação e transcendência. Caso remanesça mais de uma opção para a solução do caso, a opção ideológica deverá ser assumida explicitamente para que possa ser criticada e revisada.Palavras-chave: equidade, abstracionismo, procedimento, razoabilidade. INTR ODUÇÃOA tomada de decisões por equidade é tão antiga quanto o surgimento do direito. O rei Salomão viu-se numa situação difícil ao ter que decidir sobre a maternidade de uma criança, tendo que ser criativo para encontrar a melhor solução para o caso concreto. Os pretores peregrinos, na Roma antiga, a utilizavam para construir soluções em conflitos que envolviam cidadãos romanos e estrangeiros.2 Na ausência de regras inovavam com fórmulas que se tornavam paradigmas para a decisão de outros casos.Modernamente, com a crescente influência do positivismo lógico-jurídico, a equidade perdeu seu prestígio e praticamente caiu em desuso, em razão dos pressupostos da infalibilidade do legislador e da capacidade cognitiva do intérprete de desvendar enunciados normativos. Estes pressupostos, aliás, caracterizam os Estados de Direito ocidentais do sec. ResumoO artigo investigou como o liberalismo político de John Rawls pode oferecer argumentos razoáveis para equacionar os dilemas políticos, econômicos e sociais ocasionados pela pandemia de COVID-19. Apesar de a teoria de Rawls aplicar-se, especificamente, para sociedades bem ordenadas quase-justas, nos §§ 10 e 11 da Conferência VIII do livro Liberalismo político, o filósofo discute a forma de se governar em ocasiões de emergência que afetam a estabilidade das instituições do Estado de direito. A partir da diferenciação entre os tipos de instabilidade institucional (crise e tensão), indicou-se que a situação gerada pela COVID-19 assemelha-se ao contexto de tensão. Utilizando o liberalismo político de John Rawls para esse contexto de tensão, é possível afirmar a razoabilidade do argumento favorável a restrições à liberdade de ir e vir e de empreender, em favor da não exposição das pessoas a riscos excessivos de morte.Palavras-chave: Justiça. Liberalismo político.AbstractThe article investigated how the political liberalism of John Rawls can offer reasonable arguments to address the political, economic and social dilemmas caused by the COVID-19 pandemic. Although Rawls' theory applies specifically to well-ordered societies, in §§ 10 and 11 of Conference VIII of Political Liberalism, the philosopher discusses how to govern in times of emergency that affect stability institutions of the rule of law. From the differentiation between the types of institutional instability (crisis and apprehension), it is indicated that the situation generated by COVID-19 is similar to the context of tension. Using John Rawls' political liberalism in this context of tension, it is possible to affirm the reasonableness of the argument in favor of restricting the freedom to go and the entrepreneur, in favor of not exposing people to excessive risks of death.Keywords: Justice.
