This research aims (i) to elaborate about a central government plan on repositioning the structure of inspectorate; (ii) to explain responses of some inspectorate officers regarding the plan; and (iii) to provide suggestions on the adjustment plan that should be taken into consideration by the central government. This research found that, different with the public perception, the plan is not intended to reposition all the inspectorates, rather to inspectorates attached to local governments. These inspectorates are designed to be what thecalled 'kuasi vertical institution'. Meaning, it has a mixed character of both central and local government institution. This initiation increases the the echelon of the the head of local insepectorate and influences the relation between local inspectorate and head of local government. Officers who pros with this plan believe that this will enhance their independency (nb. we believe that the used term suppose to be impartiality); therefore, they will be more immune from the intervention.
A written informed consent has been given for all medical acts in Ghrasia Hospital. This to be observed such as the juridical force of informed consent which is given at the beginning of the medical treatment, and the legal protection to Ghrasia Hospital Pakem Yogyakarta related to informed consent which is given at the beginning of the medical treatment. This research shows that the informed consent was valid only for medical acts performed as an initial treatment. Moreover, the hospital must tell the family about the medical treatment that has been done. Sebuahinformed consenttertulis diberikan untuk seluruh tindakan kedokteran di Rumah Sakit Ghrasia, menimbulkan dua hal yang perlu diteliti, yaitu: kekuatan yuridis informed consentyang diberikan pada saat permulaan pasien penderita gangguan jiwa akan menjalani perawatan pada Rumah Sakit Grhasia Pakem Yogyakarta dan perlindungan hukum terhadap Rumah Sakit Grhasia Pakem Yogyakarta berkaitan dengan diberikannya informed consentpada saat permulaan pasien penderita gangguan jiwa akan menjalani perawatan. Hasil penelitian menyatakan bahwa: Pertama, informed consenthanya sah untuk tindakan kedokteran yang dilakukan sebagai penanganan awal pasien. Kedua, rumah sakit wajib segera memberitahukan kepada keluarga atas tindakan kedokteran yang telah dilakukan.
The management of mineral and coal mining by Freeport has been carried out since 1967 based on a work agreement/contract of work, which is regulated in Law No. 11 of 1967 concerning Basic Mining Provisions. Since the enactment of Law no. 4 of 2009 concerning Coal Minerals under the authority in the management of minerals and coal changed from a work agreement/contract of work to a mining business permit. This article will try to respond to opportunities for contract extension or termination of work contacts and see which regimes will provide greater opportunities for the benefit of the state (in the sense of greater chance of realizing people's welfare). The provisional hypothesis of this article is that the licensing regime is more appropriate to be the basis for implementing the management of mineral and coal mining.
Penelitian ini bertujuan untuk mengetahui dan mengkaji kedudukan Memorandum Of Understanding (MoU) dalam penyelenggaraan perjanjian kerjasama daerah berdasarkan Peraturan Pemerintah No. 28 Tahun 2018 Tentang Kerjasama Daerah serta pemahaman bagi pemangku kebijakan mengenai hakikat MoU dalam Perjanjian Kerjasama Daerah. Penelitian ini menggunakan metode penelitian yuridis empiris. Penelitian ini dilakukan dengan mengkaji data primer dan data sekunder yang kemudian dianalisis secara kualitatif untuk menjawab permasalahan yang diangkat. MoU wajib dibuat sebagai syarat untuk dapat membuat perjanjian kerjasama daerah berdasarkan amanat Pasal 6 ayat (1) Peraturan Pemerintah No. 28 Tahun 2018 Tentang Kerjasama Daerah dimana salah satu tahapan yang harus dilalui adalah penyusunan dan penandatanganan kesepakatan bersama. MoU memiliki fungsi kontrol dari Kepala Daerah terhadap penyelengaraan kerjasama daerah, mengingat hubungan hukum yang timbul dalam penyelenggaraan kerjasama daerah berdimensi publik yang didasarkan pada pertimbangan efisiensi dan efektivitas pelayanan publik serta saling menguntungkan para pihak.
This study aims to know and analyze and examine the realization of good governance principles in fisheries management regulation in Indonesia; analyze and formulate the ideal fisheries management regulation model in accordance with the concept of good governance.This research is normative juridical research, which is research that puts law as a building of norm system, consisting of principles, norms, rule of law, judgment, agreement, and doctrine. The approach used in this normative legal research is the statute approach and the conceptual approach. The data obtained were analyzed by qualitative method. Based on data analysis, it can be concluded that 1) Realization of 8 Main Characteristics of good governance according to UNESCAP are participation, orientation on consensus, accountable, transparent, responsive, effective and efficient, fair and inclusive and follow the rule of law in law, and efficient that cannot be applied; 2) The ideal fisheries management model in accordance with the principle of good governance is a co-management model, because this model use community empowerment and involve all stakeholders as well.
