This research aims (i) to elaborate about a central government plan on repositioning the structure of inspectorate; (ii) to explain responses of some inspectorate officers regarding the plan; and (iii) to provide suggestions on the adjustment plan that should be taken into consideration by the central government. This research found that, different with the public perception, the plan is not intended to reposition all the inspectorates, rather to inspectorates attached to local governments. These inspectorates are designed to be what thecalled 'kuasi vertical institution'. Meaning, it has a mixed character of both central and local government institution. This initiation increases the the echelon of the the head of local insepectorate and influences the relation between local inspectorate and head of local government. Officers who pros with this plan believe that this will enhance their independency (nb. we believe that the used term suppose to be impartiality); therefore, they will be more immune from the intervention.
Banyak pihak meyakini good governance adaiah meta-konsep yang dapat diimplementasikan pada seiuruh level. Tuiisan ini berupaya membuktikan hai tersebut dengan meninjau bagaimanakah pembadanan good governance dari "konsep" menjadi "asas", khususnya di sistem pengadaan barang/jasa. Untuk itu, tuiisan ini akan mengelaborasi konsep dan sejarah good governance, kemudian menunjukkan bagaimana konsep tersebut terserap dan bekerja sebagai asas. Tuiisan ini akhirnya berkesimpuian bahwa good governance adaiah konsep yang "avant la lettre", yang mana konsep tersebut telah terbadankan secara utuh sebagai asas good governance, namun terbadankan dengan beberapa modifikasi sebagai asas di sistem pengadaan barang dan jasa. This research aims to find out the reason of lecturers are not interested in competing the research funding of higher education. Afterwards, this research then discusses well the government’s action to respond the problem and then attempts to criticize and suggest solutions towards the action. This research was an empirical normative research, with data analysis based on qualitative method. This research concludes that some lecturers are not interested in doing research through the above mentioned scheme due to: (i) obligation to report of what so called “disposable finance”; (ii) lack of availability for sustainable research scheme; and (iii) unbalanced obligations of the lecturers as stipulated in “Tridharma Pendidikan Tinggi”. The government action in this respect are issuing Financial Ministerial Regulation Number 106/2016; Research, Technology, and Higher Education Ministerial Regulation Number 69/2016; and lately the Presidential Law Number 16 Year 2018 about government procurement. However, these regulations merely answer some of the problems. Asbtrak Penelitian ini bertujuan untuk mengetahui alasan dosen tidak tertarik berkompetisi dalam pendanaan riset pendidikan tinggi dari negara. Setelah itu, penelitian ini akan membahas langkah hukum pemerintah dalam merespon masalah tersebut dan kemudian mencoba memberikan kritik serta tawaran solusi atas langkah hukum tersebut. Penelitian ini merupakan penelitian normatif empiris, dengan analisis data didasarkan pada metode kualitatif. Penelitian ini menyimpulkan bahwa beberapa dosen tidak tertarik melakukan penelitian melalui skema yang disebutkan di atas karena: (i) kewajiban untuk melaporkan dengan apa yang disebut “keuangan habis pakai”; (ii) kurang tersedianya skema penelitian berkelanjutan; dan (iii) kewajiban dosen yang tidak seimbang sebagaimana ditetapkan dalam “Tridharma Pendidikan Tinggi”. Langkah hukum pemerintah adalah mengeluarkan Peraturan Menteri Keuangan Nomor 106/2016; Peraturan Menteri Riset, Teknologi, dan Pendidikan Tinggi Nomor 69/2016; dan Peraturan Presiden Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah. Namun, peraturan tersebut hanya menjawab beberapa permasalahan.
This paper describes the implementation of the public participation rule in the disaster management of Merapi volcano. The regulation desires for a shift of paradigm from centralized disaster management to participative disaster management. This study shows the government has not shifted from the old paradigm of centralized disaster management. Tulisan ini menggambarkan pelaksanaan aturan partisipasi masyarakat dalam penanggulangan bencana gunung api Merapi. Peraturan menginginkan pergeseran paradigma penanggulangan bencana dari sentralistik ke penanggulangan bencana yang partisipatoris. Penelitian ini menunjukkan Pemerintah belum sepenuhnya beralih dari paradigma penanggulangan bencana sentralistis.
