La répression pénale de l’« homosexualité » en France a été peu étudiée durant la période où furent en vigueur des lois la réprimant (1942-1982). À partir des statistiques fournies par le Compte général de la justice (CGJ), cet article propose une analyse quantitative des peines prononcées pour motif d’« homosexualité » par la justice française ainsi qu’un profilage sociologique des personnes majeures condamnées pour ce motif. Il en ressort qu’environ 10 000 condamnations pour délit d’« homosexualité » ont été prononcées en France à l’égard de prévenu·e·s majeur·e·s. Au cours de la période étudiée, le nombre de condamnations augmente graduellement entre 1945 et 1960 (pour atteindre 442 condamnations en 1961) puis décroît lentement à partir de 1968. Les personnes condamnées pour délit d’« homosexualité » sont principalement des hommes célibataires de moins de 40 ans, sans enfants, de nationalité française et appartenant aux classes populaires urbaines. Ils écopent pour la moitié d’entre eux de peines de prison de trois mois à un an. Toutefois, hommes et femmes de tous âges et de toutes les classes de la population sont poursuivi·e·s devant les tribunaux dans tous les départements français, outre-mer comprise. En termes de volume, l’« homosexualité » a donc fait l’objet d’une répression pénale modérée, si on compare par exemple avec les 133 000 condamnations prononcées pour « outrage public à la pudeur » sur la même période. Il n’en reste pas moins que plusieurs milliers de personnes ont fait l’objet de condamnations et que la pénalisation a largement nourri le stigmate associé à ces sexualités.
International audienceCet article propose une analyse sociolinguistique du désir bisexuel. Il examine ses usages langagiers et les modalités de son expression au sein d’un journal intime rédigé par un homme qui se définit lui-même comme bisexuel : Eugène Wilhelm (1885-1951). L’analyse se fonde en premier lieu sur une étude lexicométrique et harissienne du lemme « désir ». Puis, au moyen d’une étude diachronique, elle se prolonge sur les formes de construction d’une trajectoire bisexuelle. Tout en admettant que les usages langagiers du désir sont toujours socialement et historiquement situés, l’analyse permet de montrer que les expressions langagières du désir s’inscrivent au sein d’une double dynamique : celle d’une écriture qui pallie un manque et celle de la production d’un savoir dont l’objectif participe de la définition, de la hiérarchisation et de la satisfaction des désirs ainsi exprimés. Au final, cet article montre qu’un examen des usages langagiers du désir au sein de ce journal intime participe d’une quête d’unité du diariste dont l’aboutissement est le dépassement des règles morales et des normes sociales en vigueur au sein de la société bourgeoise du XXe siècle
