U radu se iznose novine koje u području nasljeđivanja donosi provedba Uredbe br. 650/2012 Europskog parlamenta i Vijeća od 4. srpnja 2012. o nadležnosti, mjerodavnom pravu, priznavanju i izvršavanju odluka i prihva- ćanju i izvršavanju javnih isprava u nasljednim stvarima i o uspostavi Europske potvrde o nasljeđivanju. Osobita se pažnja poklanja odredbama kojima je uređena nadležnost, tijela koja postupak provode kao i postupci koji će se provoditi u povodu Uredbe br. 650/2012 o nasljeđivanju. U tom se smislu u prvom dijelu rada detaljno analiziraju odredbe koje vezano uz primjenu Uredbe br. 650/2012 o nasljeđivanju donose Provedbena uredba Komisije br. 1329/2014 оd 9. prosinca 2014. o uspostavi obrazaca iz Uredbe br. 650/2012 Europskog parlamenta i Vijeća o nadležnosti, mjerodavnom pravu, priznavanju i izvršavanju odluka i prihvaćanju i izvršavanju javnih isprava u nasljednim stvarima i o uspostavi Europske potvrde o nasljeđivanju kao i odredbe hrvatskog Zakona o provedbi Uredbe br. 650/2012 o nasljeđivanju. U drugom dijelu rada analizira se predmet C404/14 Matoušková v. Republika Češka te se upućuje na poteškoće u pogledu razgraničenja područja primjene Uredbe (EZ) br. 2201/2003 te Uredbe br. 650/2012 o nasljeđivanju do kojih bi moglo doći u pojedinim predmetima s međunarodnim obilježjem.
<span>At EU level, discussions on the future direction of development of consumer protection policy revolve around the open question of efficiency of mechanisms for protection and realisation of consumer rights in national legal systems of EU Member States. Measures and activities of the EU legislator resulted in ‘competing’ mechanisms, which objectively creates a need for examination of the extent to which their functions overlap as well as if it is possible to detect the (most) appropriate way for protection of consumer rights. The analysis in the paper starts from the presumption that the consumer protection policy was developed within the measures aimed at integration of the Single Market and harmonization of consumer laws, on the one side and the recognized need of consumer protection as a social and political goal, on the other side. In this sense, the main point discussed in the paper is whether the recent development in the field of consumer protection, including the recent judgments of the European court could be interpreted as a reflection of the notion that the efficient judicial protection of (individual) consumer rights is (yet) again a priority at EU level. In the first part of the paper the development and application of mechanisms which represent a certain kind of alternative to the judicial consumer protection will be presented. In the second part of the paper, we will consider if the all the more present focus on judicial protection of consumer rights at EU level is an indication of a ‘successful experiment which resulted in unexpected outcome’. The required argumentation will be provided through monitoring of the trend of ‘proceduralization’ or ‘europeanisation’ of the national consumer law in the jurisprudence of the European court. The effect of Article 47 EU Charter of Fundamental Rights and its requirement of efficient protection of procedural rights of individuals before national courts of EU Member States will be analysed in detail. At the same time, the recent activities of the European Commission directed at court proceedings before national courts and removal of barriers in their work in the field of consumer protection will be taken into account.</span>
Matters of jurisdiction seem to be among aspects of judicial cooperation in civil and commercial matters in which so far most regulatory activity of the European union (hereinafter: EU) has been undertaken. Upon close examination of the rules on jurisdiction of courts in civil and commercial matters in the existing legal framework at EU level, it becomes obvious that they contain the same principle of territoriality. At the same time, in the course of modernization both at the national and EU level it seems that the principle of functionality is becoming more dominant. A question whether it is justified to depart from rules on jurisdiction based on the principle of territoriality and confer jurisdiction on a court other than that of the defendant's domicile based on the principle of functionality in a cross-border case has arisen recently in joined cases C-400/13 and C-408/13. Within the context of a rather ambiguous view the CJEU took in its decision in the aforementioned cases, the paper examines if enhancing functionality through concentration of jurisdiction will eventually become an advantage or obstacle to access to justice. The analysis includes presentation and comparison of provisions on jurisdiction in cross-border cases based on the principle of territoriality and functionality respectively in several EU legal instruments regulating private international law and civil procedure matters. The paper attempts to draw attention to models of achieving procedural efficiency in different fields of EU's activity, such as enhancing consumer protection or introducing cross-border collective redress.
Bankarska garancija na poziv (dalje: BG) u hrvatskom i poredbenim pravimajedno je od najčešćih sredstava osiguranja koje ima za cilj brzu i učinkovituisplatu novčanog iznosa iz BG-a ako druga strana ne ispuni svoju ugovornuobvezu. Ako banka izda BG, obveza banke na isplatu novčanog iznosa iz BG-a jesamostalna, a ne akcesorna. Drugim riječima, ako se ispune uvjeti iz BG-a bankaneće moći isticati prema korisniku prigovore iz temeljnoga posla. Mogućnostzloupotrebe prava na naplatu iznosa iz BG-a otvara pitanje do koje mjere trebaslijediti jedno od temeljnih načela kod BG-a „plati pa se sudi“. Stoga i ne čudi daje unatoč navedenim teorijskim koncepcijama o BG-u pred hrvatskim sudovimazamjetan trend povećanja prijedloga za određivanje privremenih mjera kod BGa,a u novijoj hrvatskoj literaturi o tome se nije sustavno raspravljalo. Slijedomnavedenoga, autorice propitkuju dopustivost određivanja privremenih mjerakod BG-a, analiziraju pretpostavke za određivanje privremenih mjera i dajuocjenu postojećega stanja dovodeći u suodnos svrhu i temeljna načela BG-a sasvrhom i pravilima Ovršnog zakona o privremenim mjerama.
U hrvatskome su pravnom poretku određeni ljudskopravni standardi ukorijenjeni u praksu postupanja u građanskome sudskom postupku te se osjećaju njegovim sastavnim dijelom, premda su svoje izvorište imali u Europskoj konvenciji za zaštitu ljudskih prava i temeljnih sloboda, a u novije vrijeme i u Povelji EU-a o temeljnim pravima. Iz toga se može zaključiti da proces europeizacije građanskoga parničnog postupka, koji se zbog rastućeg utjecaja Europske unije na nacionalni građanski parnični postupak tek počinje osvještavati, zapravo već dulje vrijeme traje. Velik doprinos integriranju postulata prava EU-a u nacionalne građanske parnične postupke daje razvoj sekundarnog prava u okviru pravosudne suradnje u građanskim i trgovačkim stvarima posljednjih godina. Uz to, bitna je uloga judikature Suda Europske unije te preuzimanja postupovnih pravila implementacijom pojedinih direktiva, koje unatoč svojoj materijalnopravnoj prirodi, takva pravila sadržavaju. Stoga, polazeći od Rewe-Comet doktrine 'postupovne autonomije' država članica, u radu se želi istražiti kako je europeizacija do sada (pre)oblikovala određena obilježja hrvatskoga građanskog parničnog postupka. Pri tome, ključno je pitanje na koje se želi odgovoriti – jesu li tako u funkcioniranju građanskog pravosuđenja u RH ostvareni preduvjeti potrebni za uzajamno povjerenje te pravosudnu suradnju s drugim državama članicama te zaštitu temeljnih ljudskopravnih standarda koje promiče pravo EU-a?
