Contestée, discutée, fortement amendée, la loi ELAN, finalement adoptée par le Parlement, a été également validée, dans ses principes, par le Conseil constitutionnel. Or, au-delà de l'assouplissement des contraintes établies au cours des quarante dernières années en matière de construction, les principes de la loi ELAN engagent une véritable philosophie de l'espace. On pourrait s'étonner d'ailleurs de la franchise avec laquelle, malgré le contexte actuel, celui d'un autre « élan », plutôt en faveur de la protection de l'environnement, le titre premier de la loi affiche son objectif : « construire plus, mieux et moins cher ». Si, à première vue, nous avons du mal à voir dans cette phrase un simple slogan des promoteurs de l'immobilier, c'est parce que le discours justificatif de la loi, que le Conseil constitutionnel a repris dans sa décision, est mené sur le terrain du « pragmatique ». Pour quelle raison seulement 20 %, au lieu de 100 %, des bâtiments nouveaux doivent-ils être accessibles aux personnes à mobilité réduite ? C'est évident : non seulement les personnes à mobilité réduite sont une minorité sur le territoire, mais ces contraintes empêchent la construction de logements pour la majorité de la population 1. Opposer majorité et minorité est un argument classique. Pour quelle raison doit-on assouplir la « loi littoral » ? C'est évident là encore : la construction des logements à côté de la mer permet d'améliorer l'offre de logement. Opposer protection de l'environnement et bien-être social est un argument, là aussi, classique.

La question prioritaire de constitutionnalité (QPC), mécanisme de progrès indiscutable pour la protection des droits et libertés constitutionnellement garantis, est un nouveau lieu de travail pour le juge constitutionnel français. Le contrôle de constitutionnalité a posteriori l'invite, en effet, non seulement à perfectionner son contrôle dans un contexte nouveau, mais à élaborer également de nouvelles techniques jurisprudentielles. La tendance, toute naturelle à ses débuts, a consisté cependant en la simple transposition de la « logique » du contrôle a priori au contrôle a posteriori. L'exemple le plus marquant est celui de « l'incompétence négative ». Le juge constitutionnel a ainsi estimé que le grief tiré de « l'incompétence négative » pouvait être invoqué à l'appui d'un recours dans le cadre de l'article 61-1 de la Constitution, dès lors que le législateur n'avait pas épuisé sa compétence en matière d'exercice des droits et libertés fondamentaux, matière que la Constitution lui réserve exclusivement 2. L'incompétence négative est à l'origine une notion de droit administratif et elle est généralement définie, bien que la notion ait évolué depuis son apparition dans les écrits de LAFERRIERE, comme le fait, pour l'autorité compétente, de n'avoir pas utilisé pleinement les pouvoirs que les textes lui ont attribués 3. Il s'agit là d'une technique de contrôle que le juge administratif a donc inspirée au juge constitutionnel, ce dernier l'ayant utilisée, dans sa jurisprudence, afin de faire respecter la « réserve de loi » telle qu'instituée par l'article 34 de la Constitution.
