A participação de homens e mulheres no mercado de trabalho não é igualitária, uma vez que essas possuem menores salários, estão mais propensas ao desemprego e encontram maiores dificuldades para atingir cargos mais altos dentro da hierarquia empresarial. Essa situação, contudo, contradiz o ordenamento jurídico, que protege a participação feminina no mercado de trabalho e veda a sua discriminação. As normas protetivas se encontram não apenas no âmbito constitucional, mas também nas leis nacionais e tratados internacionais pertinentes. Para que a realidade fática reflita os valores prestigiados pelo ordenamento, o Estado disfruta de alguns instrumentos, entre os quais se destaca o orçamento e a tributação. Neste prisma, a variação de alíquotas de um determinado tributo pode funcionar de forma a induzir comportamentos desejados, o que se chama de função indutora da tributação. Esse mecanismo pode, inclusive, trazer benefícios àqueles que obedecem aos mandamentos do ordenamento jurídico e oferecem oportunidades igualitárias entre seus empregados e empregadas. Assim, considerando que é garantido um abono salarial a todos que ganham menos de dois salários mínimos mensais, uma isenção da contribuição para o PIS surge como uma alternativa, já que não apenas implica na melhoria das condições das mulheres, mas também significa uma economia para o próprio Estado, que deixará de pagar o abono salarial a muitas mulheres que ultrapassem o valor mínimo para o recebimento do abono.
