A person with a disability has the right to be treated the same as other human legal subjects. Therefore, the government is obliged to realize the rights listed in the convention, using laws and regulations, including how to fulfill the rights of persons with disabilities in every aspect of life such as: a decent living, education, health and so on, just like humans who live with disabilities. other normal. An autistic person or what in psychological terms is called autism, is included in the category of a person with a mental disability. A person is said to be autistic if he experiences abnormalities in carrying out a legal act, development in terms of the quality of the ability to carry out social and emotional relationships in the social environment of the community. A person is said to have autism, namely someone who has a special character in people generally not by showing mental (psychic), emotional (affective) or physical (physical) disabilities. The word autism, namely "auto" means everything that is directed at the individual. According to information that is not difficult to understand, autism is an abnormality in the brain that causes a decrease or loss of a person's ability to communicate, relate to others and respond to the environment or environment.
Flats are a response to the needs of housing for the community and become an alternative choice for providing ideal housing for developing countries. The purpose of research and writing of this scientific paper through the normative approach method is to analyze the Activities of Management of Flats by the Management Agency, the existence of the Association of Owners and Occupants of Apartment Units (PPPSRS), Voting Rights Related to the Authority of Management and Management of Rental Flats compared to Management of Flats Commercial. In this study using an empirical juridical approach because the researcher was carried out directly on the manager of the rental apartment. The scope of this research is the management of flats and its objects are flats in urban areas. The materials used are field materials and library materials. The data collection technique is document study and the analysis technique is qualitative analysis. The activity of managing the apartment is obliged to be the manager of a legal entity, namely the Association of Owners and Residents of Apartment Units which have been made a legal deed by the Regent or Mayor of the Level II Region and the determination of the voting rights of these members has not been fully realized. Management of simple rental apartments is required by Technical Management Unit (UPT), while Management of Commercial Flats is the Management Body of Commercial Flats, which is the Association of Owners and Occupants of Flat Units, developer as a temporary Management Agency.
Introduction: Land dispute over the Watolo family was not settled for nearly two decades, on the initiative of one side so that the issue was taken to kelurahan to be settled mediation.Purposes of the Research: To find out the legal force of the minutes of the settlement of land disputes by Watolo Village which is used as the basis for land rights. Methods of the Research: The research method used is the type of normative legal research that is descriptive analytical.Results of the Research: Based on this research, the minutes issued by the kelurahan are not the minutes of the proper meeting and cannot be used as a basis for rights because there are no laws or regulations that guarantee the strength of law and legal certainty and the minutes cannot be used as a basis for internal rights but can be used as evidence by both parties when the land dispute is continued to the trial stage in court.
This research is intended to help English teachers both at the college and high school levels in using portfolios as an evaluation tool in writing skills. Portfolio assessment was chosen in this research because of its wide use and easy adaptation to various needs. This study used Research and Development method. The development stage is based on the IQF curriculum implemented in English Language and Literature Department, Universitas Negeri Surabaya. The exploratory writing skills held for students are expected to help them in further writing, namely Thesis Proposal Writing and Academic Journal Writing where students will write down their thoughts about a concept or phenomenon and present an explanation accompanied by adequate research data. The results of the study show that the use of portfolio is quite positive. There is an improvement in students’ writing after applying a portfolio as an evaluation tool for writing skills. However, some additions need to be made to improve the quality and format of the portfolio as an evaluation tool for writing skills.
Suatu usaha tidak selalu berjalan dengan baik dan lancar, sering kali keadaan keuangan pelaku usaha tersebut sudah sedemikian rupa hingga sampai pada suatu keadaan dimana pelaku usaha tidak mampu lagi membayar utang- utangnya yang telah jatuh tempo. Para Kreditor yang mengetahui bahwa Debitor tidak mampu lagi membayar utang-utangnya akan berusaha untuk terlebih dahulu mendapatkan pelunasan atas piutangnya. Para kreditor mungkin saja memaksa debitornya untuk menyerahkan barang-barang guna pelunasan hutang-hutangnya, atau dapat juga debitor diminta untuk melakukan perbuatan yang hanya menguntungkan satu atau beberapa kreditor saja sedangkan kreditor yang lainnya dirugikan. Tindakan Kreditor atau perlakuan Debitor yang demikian jelas akan memberikan ketidakpastian bagi Kreditor lain yang beritikad baik yang tidak ikut mengambil barang-barang Debitor sebagai pelunasan piutangnya, sehingga piutang Kreditor yang beritikad baik tersebut tidak terjamin pelunasannya. Berdasarkan hal-hal tersebut di atas, maka dibutuhkan suatu lembaga yang dapat menyelesaikan masalah dan dapat memberikan suatu kepastian hukum, sehingga kejadian-kejadian sebagaimana disebut di atas dapat dicegah. Salah satu contoh kasus penyelesaian utang Debitor terhadap Kreditor melalui kepailitan yang dalam prosesnya kurang tepat dalam menerapkan ketentuan syarat permohonan pailit dalam UU No.37 Tahun 2004 adalah kasus kepailitan PT. Hendratna Plywood dengan para Kreditornya yaitu PT. Ocean Global Shipping dan PT. Samudra Naga Global. Dimana PT. Hendratna Plywood membayar hutangnya kepada salah satu Kreditornya, yakni PT. Samudra Naga Global pada saat 14 (empat belas) hari setelah permohonan pailit didaftarkan di Pengadilan Niaga Jakarta Pusat. Dengan adanya pembayaran tersebut, syarat kepailitan dalam UU No. 37 Tahun 2004 yaitu adanya 2 (dua) kreditor atau lebih dan suatu utang yang telah jatuh tempo dan dapat ditagih menjadi tidak terpenuhi lagi. Lebih lanjut hal tersebut menimbulkan permasalahan yaitu dimana PT. Hendratna Plywood yang telah membayar utangnya menuntut agar kepailitan dibatalkan. Sedangkan PT. Ocean Global Shipping menuntut agar PT. Hendratna Plywood tetap dipailitkan meskipun utang terhadap salah satu Kreditor telah dibayar lunas. Namun pada akhirnya Pengadilan Niaga pada Pengadilan Negeri Jakarta Pusat dengan putusan No. 16/2010. Pailit/PN.Niaga.Jkt.Pst menjatuhkan putusan pailit kepada PT. Hendratna Plywood dengan segala akibat hukumnya.
