O presente trabalho busca demonstrar que mesmo após 50 anos do Pacto de San Jose da Costa Rica ainda se busca resolver o problema do papel dos princípios orientadores das prisões cautelares. A hipótese elencada é de que os princípios orientadores das prisões cautelares devem possuir força vinculante quando da ocorrência de sua decretação ou manutenção, sempre no sentido de garantir a preservação de direitos fundamentais. Objetiva-se realizar uma análise crítica dos princípios orientadores das prisões cautelares intentando verificar seu conteúdo e abrangência, bem como seu nível de observância pela legislação. Para atingir o objetivo do estudo, foi empregado o método indutivo, além dos meios de pesquisa documental e bibliográfico. As pesquisas se deram por meio de doutrinas gerais e específicas sobre o assunto, bem como artigos científicos, tendo sido utilizado como base para a elaboração do trabalho o Pacto de San Jose da Costa Rica. Justifica-se a pesquisa pelas contribuições que pode proporcionar ao campo social a partir de uma análise teórica e prática. Toda prisão cautelar cerceia a liberdade do indivíduo, por isso a decisão que a decreta ou mantém exige observância a princípios. Conclui-se que os princípios orientadores das prisões são fundamentais à aplicação das mesmas. Os princípios devem possuir força normativa e, se necessário, sobrepor-se às disposições infraconstitucionais e às decisões inconstitucionais, que firam os direitos fundamentais de liberdade.
The present reasearch proposes to make an analysis of the electronic process in the current Brazilian legal system, as well as the devices brought by the new Civil Procedure Code that referred to this type of process. The subject under study is of great relevance at present, since it is related to the internet and with a new procedural form, being concerned with observing how the information society deals with this new type of technology and how it can be applied for procedural benefit for the parties to the dispute. The issue raised is part of how the electronic process can help to alleviate the very high number of lawsuits that are currently being processed in the Judiciary, through the promotion of constitutional mandates, and to ensure greater procedural effectiveness. It is studied, then, the principles that are somehow directly linked to the electronic process, namely, the due process of law; the one of the ample defense; access to justice; advertising; the reasonable duration of the process and equality, seeking to explain how these guarantees can be benefited by the electronic process. In the end, some criticisms are made of the adoption of the electronic process as the only solver of delays in Brazilian courts. In this way, the objective is to analyze the electronic process in the new Civil Procedure Code and its relationship with modernity, considering its effects within the Brazilian legal system. To achieve this goal, the work is based on hypothetical-deductive and dialectical methods, as well as documental, electronic and bibliographical resources.
A pesquisa busca solucionar o problema da falta de um modelo adequado para a fundamentação das decisões que tratam sobre prisões cautelares tendo em vista a sua inadequada aplicação prática. Utiliza-se como hipótese um modelo argumentativo baseado na proporcionalidade e apresentado em forma de axiomas, o qual seria capaz de resolver o problema da fundamentação, pois atrelado a preservação de direitos fundamentais. Objetiva-se, então, estabelecer um modelo para a fundamentação de decisões judiciais que tratam sobre prisões cautelares com vistas a reduzir a discricionariedade. Para atingir o objetivo do estudo, foi empregado o método dedutivo, além dos meios de pesquisa eletrônico e bibliográfico. As pesquisas se deram por meio de doutrinas gerais e específicas sobre o assunto, bem como artigos científicos. Como referencial teórico utiliza-se a doutrina de Robert Alexy, de Luigi Ferrajoli, bem como a crítica hermenêutica do direito de Lenio Streck. Conclui-se pela necessária utilização da proporcionalidade a partir de uma leitura da hermenêutica filosófica pela decisão que decreta ou mantém prisões cautelares, sendo sempre necessário atentar-se para a gravidade da medida imposta e o fim que ela procura tutelar. Não se deve admitir medidas inadequadas, desnecessárias ou extremamente gravosas, devendo-se observar as circunstâncias concretas do fato, sendo incabíveis motivações genéricas e abstratas.
RESUMOO artigo se propõe a analisar como o princípio da proporcionalidade está sendo utilizado no contexto das interceptações informáticas, estando o tema ligado à vigilância digital para a garantia da segurança pública e a proteção da privacidade. A análise se dá pela observância de como ordenamentos jurídicos estrangeiros (EUA, Alemanha, Portugal) tratam a matéria, tendo em vista os programas de interceptação americanos e sua declarada guerra ao terrorismo, a jurisprudência alemã e a sua visão de proporcionalidade e Portugal pela regulamentação do tema por determinação da União Europeia. Constatou-se que a proporcionalidade tem sido utilizada como modo de balizar o conflito de interesses gerados pela colisão dos direitos fundamentais. A preservação da privacidade mostrou-se privilegiada, restando, como exceção, os programas de espionagem do governo norte-americano. Para atingir o objetivo do estudo, foi utilizado o método dedutivo, além de meios de pesquisa eletrônicos e bibliográficos.Palavras-chave: Princípio da Proporcionalidade; Colisão de Direitos; Segurança Pública; Privacidade; Interceptação de dados. ABSTRACTThe article proposes to analyze how the principle of proportionality is being used in the context of computer intercepts, linked the subject to the digital surveillance to guarantee public safety and the privacy protection. The analysis is based on observance of how foreign legal systems (USA, Germany, Portugal) deal with the matter, because of the American interception programs and their declaration of war on terrorism, the German jurisprudence and their view of proportionality and Portugal by regulating the subject by determination of the European Union. It has been observed that proportionality has been used as a means of assessing the conflict of interests generated by the collision of fundamental rights. The preservation of privacy has been privileged, with the exception of the espionage programs of the US government.
