Este artículo parte de la siguiente pregunta: ¿Cómo una débil amenaza puede convertirse en una amenaza real, incluso ante la ausencia de una amenaza concreta? Para lo cual se plantea como hipótesis que los factores que pueden llevar a que esto ocurra en el caso de la implementación de la Alianza para el Progreso fueron 1. La oposición de visiones entre personal militar y diplomático, 2. La transmisión de información sesgada por parte de los tomadores de decisión de un país aliado y 3. La influencia de sistemas de creencias preexistentes. La innovación del enfoque propuesto radica en el uso de la teoría del realismo defensivo para evaluar por un lado el rol de las capacidades materiales y por el otro de las percepciones de los tomadores de decisión en la creación de una amenaza real desde una débil. Así se llega a la conclusión que los aspectos cognitivos pueden derivar en la sobreestimación de una amenaza mediante la equivocada disposición de las capacidades materiales.
El presente artículo de investigación busca analizar los principales aspectos de las teorías del derecho internacional de Hans Kelsen y Herbert Hart desde una perspectiva crítica. Para lograr este objetivo, se realiza una investigación documental basada en un análisis de contenido de la obra directa de los autores, de otros autores que revalúan esta obra y de exponentes de la teoría crítica del derecho internacional y de las relaciones internacionales. Para el análisis propuesto, se escinden los planos epistemológico y normativo de las teorías citadas, lo que arroja como conclusión que hay una mayor sintonía entre las teorías positivistas y las críticas en lo que respecta al plano normativo mientras que en el epistemológico hay una fuerte discrepancia, particularmente con el positivismo metodológico de Kelsen
Este artículo de investigación tiene como propósito explorar la viabilidad y las ventajas derivadas de vincular el estatuto jurídico del personal de las Compañías Militares y de Seguridad Privada con otras figuras jurídicas más desarrolladas para ayudar a dinamizar al derecho internacional. Para tal efecto, se realiza una revisión documental basada en tratados internacionales y jurisprudencia y legislación interna de países emblemáticos.
Migratory flows between Colombia and Venezuela have been continuous and bidirectional since 1950. Depending on the period under analysis, one can find migratory flows from Colombia to Venezuela, or vice versa. During the second half of the twentieth century, intense violence and lack of economic development caused a constant migratory flow from Colombia to Venezuela. Since the beginning of the twenty-first century, this situation began to be reversed. Initially, an incipient migration to Colombia of Venezuelans with resources and high professional training occurred between 2000 and 2014. Subsequently, a massive migration flow of Venezuelans with fewer resources and limited professional training took place between 2015 and 2019, and especially between 2017 and 2019. This has been described as the largest migration wave in the recent history of Latin America. The COVID-19 pandemic has abruptly halted this migration wave from March 2020 due to several socioeconomic and political factors that are analysed in the chapter.
El objetivo de este artículo es el de analizar desde la operatividad de los códigos geopolíticos el contexto y desarrollo del conflicto entre Rusia y Ucrania entre 1991 y 2022. Para darle alcance, se valdrá del concepto de códigos geopolíticos, ya que es un marco desde el cual se puede operacionalizar la confluencia de factores, causas y jugadores implicados en este conflicto. La metodología será la del estudio de caso mediante la cual se hará seguimiento del proceso que llevó a este desenlace desde el cual las condiciones iniciales.
