RESUMO: Na disputa eleitoral, independentemente do cargo, os candidatos apostam nas propagandas eleitorais para a conquista do voto. Bem elaboradas e caras, elas buscam convencer o eleitor e, ao mesmo tempo, formar opinião acerca de suas plataformas de governos. Se o discurso utilizado já era considerado uma das ferramentas para manipular a opinião a pública, nos dias atuais, ele se aliou às tecnologias, passando a utilizar dados tais como as preocupações, preferências e oposições dos eleitores, adquiridos nas redes sociais através da inteligência artificial. Essas novas ferramentas podem influenciar uma campanha eleitoral, sobretudo, quando o impulsionamento de conteúdo tem previsão legal? O julgamento da Representação Eleitoral que condenou Fernando Haddad e a Coligação O Povo Feliz de Novo, em análise com a doutrina relativa ao tema, revela a possibilidade de implicações mais profundas, não apenas atinentes às eleições, mas dedicadas à construção da democracia. As novas tecnologias baseadas em dados, fornecidos pelos próprios usuários, podem fazer nascer uma opinião pública irreal, induzida, forjada? Ou, ao contrário, trarão maiores possibilidades de discernimento ao eleitor? O estudo do caso requer a análise de legislações relativas aos direitos digital, constitucional e eleitoral, além de interdisciplinariedade com disciplinas como sociologia e psicologia.
Desde 1962, quando da instituição do Código de Telecomunicações, os partidos políticos passaram a ter assegurado o direito de veicular propagandas partidária e eleitoral no rádio e na televisão, direito este consolidado pela Constituição Federal de 1988. Ocorre que o acesso “gratuito” ao rádio e à televisão tem inserções pagas pelo contribuinte, uma vez que as empresas de radiodifusão possuem legalmente o direito à isenção fiscal relativa a oitenta por cento dos valores que seriam pagos numa propaganda comercial. O trabalho problematiza a ideia de democratização dos meios de comunicação, dada a crise dessas agremiações e os custos para o contribuinte.
