ResumoEste trabalho situa-se na encruzilhada em que temas pertencentes a áreas aparentemente distintas e incomunicáveis que passaram a se amalgamar de tal sorte que não se pode mais pensar de forma isolada em cada uma delas sem se considerar as repercussões nas demais: meio ambiente e desenvolvimento econômico. Neste estudo, objetiva-se abordar o comportamento de um grupo específico de países, o BRICS (Brasil, Rússia, Índia, China e África do Sul), frente às questões ambientais, sobretudo a difícil conciliação entre seu desejo de alcançar um novo patamar na economia internacional e o respeito às limitações materiais para realizar esse propósito. A fim de analisar a inserção da temática ambiental no âmbito desses países, parte-se da identificação dos principais elementos que envolvem a questão ambiental nos dias atuais para então analisar o comportamento do BRICS frente ao tema, destacando, afinal, a peculiar posição do Brasil.Palavras-chave: BRICS. A relação entre os ordenamentos jurídicos nacional e internacional – tema clássico da teoria do Direito Internacional – continua a ser um assunto de grande relevância e atualidade. Dentre os estudiosos deste assunto, o jurista italiano Norberto Bobbio deixou importantes contribuições em seu legado. Com o propósito de resgatar esse legado, o presente artigo analisa o pensamento de Bobbio em alguns de seus escritos que abordam a temática. Nesta análise são enfatizadas suas principais considerações e contribuições a respeito dessa matéria. Como resultado, observa-se que Bobbio, partindo da concepção pluralista institucional concebida por Santi Romano – que oferece a ele um modelo mais adequado para lidar com a realidade social –, desenvolve critérios para lidar com a relação entre distintos ordenamentos jurídicos. Esses critérios permitem o exame da relação entre os ordenamentos nacional e internacional, seja para os defensores das correntes monistas ou dualista. Revelando sua tendência ao monismo, inspirado em Kelsen, ele idealiza a formação de um Estado universal como solução para alcançar a paz perpétua. Para a realização desse ideal universalista, Bobbio defende a evolução do direito internacional e a primazia do direito internacional, na relação entre os ordenamentos nacional e internacional. Teoricamente pluralista, mas ideologicamente monista, o pensamento do autor proporciona aspectos importantes para reflexão, especialmente sob a perspectiva da teoria do ordenamento jurídico internacional e do tema da paz.
Globalization has intensified the transformations within International Law during the last century, especially its second half. The international organizations' creation and, afterwards activities development are important parts of this process. Concerning the World Bank Group, which had been born as a single institution, this process took extraordinary proportions in both senses through its structural and functional development. Obviously, such changes cause inevitable impacts on law. Within this work, we approach these changes through a very peculiar instrument: project finance. Imported from economics, this mechanism has very uncertain legal features yet. Concerning the World Bank, it intervenes within this process in different ways: according loans, guarantees or even resolving conflicts. The development of this broad agenda inevitably gave it some regulatory powers it hadn't originally had.
