Purpose – The paper analyses the emerging role of Social Sciences and Humanities (SSH) universities in\ud contemporary society via third- and fourth-mission activities. In particular, the paper investigates the\ud potential contributions that SSH universities can offer in developing and enhancing capacities, supporting the\ud changing conception of innovation coherently through a Smart Specialisation Strategy (S3) approach.\ud Design/methodology/approach – The case study presents multiple third- and fourth-mission activities\ud carried out by the University of Macerata (Italy). The activities are framed according to the roles universities\ud could have in supporting S3.\ud Findings – Within third- and fourth-mission activities, SSH universities can play different and broader roles\ud (generative, absorptive, collaborative and leadership), which could support regions in designing and\ud implementing S3.\ud Practical implications – The paper shows the important contributions that SSH universities can make in\ud their regions, both to support S3 and enhance the transition to sustainable development.\ud Social implications – The article emphasises SSH universities’ multiple contributions to sustainable\ud development and to innovation in the knowledge society/economy framework.\ud Originality/value – This case study captures SSH universities’ contributions to S3 and the wider\ud innovation paradigm, by highlighting their transformational effect on regional economies.\ud Keywords Higher education, Entrepreneurship, Sustainability, Regional development,\ud Smart specialisation, Third and fourth mission\ud Paper type Case stud
Resumo: O presente artigo analisa o processo de formação do primeiro código penal italiano posterior à unificação política do país, o chamado Código Zanardelli de 1889. Uma análise que contextualiza a codificação não somente na cronologia dos fatos políticos, mas também, por exemplo, na ciência do direito penal italiana do século XIX. Uma ciência do direito penal-conhecida sob o nome de "escola clássica"-caracterizada por ter levantado algumas bandeiras como a abolição da pena de morte, um dos aspectos apontados, inclusive, como fator que dificultou processo de unificação legislativa no campo penal. Por fim, a título de epílogo, são abordadas as críticas da chamada "escola positiva" que se opunha a algumas tendências liberais do recém-promulgado código. Um liberalismo penal, porém, que é visto em sua ambiguidade: no interior de um código liberal, por exemplo, dispositivos rígidos para combater o dissenso político, e uma normativa extra codicem que mitigava algumas garantias consagradas no código.
La Révolution - en tant que révolution du droit - doit être envisagée à l'échelle européenne. Cela permet de lire les deux phénomènes, révolutionnaire et juridique, entre universalisme et uniformité, entre le paradigme religieux et la « patrie intellectuelle commune » envisagés par Tocqueville, entre l'« esprit de conquête » et le principe d'uniformité regardés par Constant. La conquête française et la diffusion des institutions de la Révolution et du droit révolutionnaire - notion bien controversée - montrent les tensions inévitables entre la construction, en phases, modes et moments différents, d'un grand dessein impérialiste que l'on ne peut séparer de la « patrie commune » et la dimension unitaire et uniformatrice qui est pourtant une partie fondamentale de la révolution du droit. L'étude du droit révolutionnaire en Europe ne peut donc pas consister dans la simple recherche du « droit français en Europe ». Le regard européen, au contraire, aide à relativiser - en passant par les mythologies, les paradoxes et les traditions - la tendance à construire les concepts seulement en fonction des dynamiques qui peuvent se rapporter de manière plus immédiate à l'hexagone français.
Através do exemplo italiano – mas com referências, também, à experiência de formação do chamado “sistema misto” na França e à experiência da Grã-Bretanha, tida como modelar para os reformadores continentais – o presente artigo pretende demonstrar que a “justiça criminal dos modernos” é caracterizada desde as suas origens pelo vínculo – problemático – entre justiça criminal e opinião pública. Em um primeiro momento, apesar de algumas perplexidades, a publicidade é vista como um traço indelével de uma justiça criminal de um regime liberal. Em um segundo momento, a publicidade passa a ser atacada – pelos juristas da escola positiva, por exemplo – como algo incompatível com a cientificidade do processo judicial, até que a própria publicidade perderia o seu significado original com o advento do fascismo.
