O artigo objetiva analisar o direito fundamental social à educação. Investiga a transmutação desse direito também em de personalidade, e as consequências dessa acumulação de valor. O problema que o estudo analisa é a discricionariedade do administrador público que impede o acesso ao direito à educação, quando por exemplo não disponibiliza vagas suficientes em creches para atender as necessidades da comunidade. Então, diante desse fato concreto, o indivíduo prejudicado busca o Judiciário que impõe a realização de políticas públicas. Se critica o papel ativista do Judiciário. Contudo o estudo conclui que não há desrespeito a tripartição dos poderes, pois diante da fundamentalidade a discricionariedade do administrador público se torna reduzida, quase nula. Há um dever imposto pela Constituição Federal e o Judiciário cumpre o que determina o comando legal, independente de argumentos como o da reserva do possível ou de orçamento. O princípio da complementaridade deve ser observado, pois a educação é o direito que tem condições de realizar todos os demais direitos. O método utilizado é o teórico dedutivo. No que tange a coleta de dados, a pesquisa se utilizou do levantamento bibliográfico e análise jurisprudencial.
Pretende o presente artigo tratar do novo marco regulatório da extensão universitária no Brasil previsto na Resolução n. 7 de 18 de dezembro de 2018, do Ministério da Educação (MEC). Mostrar que apesar das mudanças exigidas às instituições de ensino superior, sejam elas públicas ou particulares, a referida Resolução pode ser observada como um poderoso instrumento de política de promoção humana em favor da sociedade brasileira. Neste sentido, dependendo da forma como as entidades de educação elaborarem e desenvolverem seus projetos de extensão, os indicadores gerados terão o condão de alimentar as agendas para a formação de políticas públicas. Embora o tema extensão universitária não seja propriamente novo, as diretrizes impostas pelo dispositivo legal é assunto relevante e urgente, uma vez que o prazo para as instituições se adequarem as novas regras se extinguem em 14 de dezembro de 2021. Esse cenário que se desenha no âmbito do ensino superior exige estudos que reflitam as realidades sociais em um mundo cada vez mais globalizado. O método utilizado é o dedutivo e no que tange a coleta de dados, a pesquisa se utilizou do levantamento bibliográfico, análise jurisprudencial e coleta de dados estatísticos produzidos por órgãos e entidades do governo federal.
O objetivo desse artigo é apresentar o desenvolvimento de um modelo de processamento de dados, denominado “Prometeu”, que pretende reduzir o volume de demandas no Poder Judiciário, prevendo que no futuro, o mesmo se utilize das ferramentas da Inteligência Artificial (IA). O recorte metodológico elegeu a instância do Superior Tribunal Federal (STF). O modelo pretende estabelecer um padrão de captação de dados no momento do protocolo da demanda, bem como ao fim, com o julgamento, e assim criar um banco com palavras-chave que organizadas mostrarão quais e com que frequência determinados temas surgem. O diferencial do modelo é que os dados gerados sejam encaminhados aos demais Poderes para compor agenda de políticas públicas pertinentes. A conclusão mostra que “Prometeu” é uma ferramenta eficiente para o Judiciário e demais poderes que terão acesso a dados e informações confiáveis para a concretização dos direitos da personalidade e fundamentais. O referencial teórico se sustenta em Peter Häberle e Leonardo Secchi. Na metodologia, a pesquisa se utilizou da revisão bibliográfica em bases de dados de revistas especializadas, doutrina e legislação, bem como notícias jornalísticas. O método utilizado é o hipotético dedutivo para investigar o problema do acúmulo de processos no Judiciário.
O objetivo deste artigo é o estudo da autodeterminação informativa e o seu reconhecimento material como direito da personalidade analisado sob o viés do princípio da segurança. O atual desenvolvimento tecnológico traz benefícios à coletividade, contudo se observa que o indivíduo se tornou o produto da Sociedade da Informação, e isso viola o princípio do livre-desenvolvimento da personalidade da pessoa natural, o que justifica a presente investigação. O método utilizado é o hipotético-dedutivo, e a hipótese testada é se o direito à autodeterminação informativa é suficiente para garantir o livre-desenvolvimento da personalidade em um contexto de sociedade instrumentalizada por dados. A metodologia concentra-se na revisão bibliográfica de doutrina, legislação, artigos científicos, consulta a sites de órgãos oficiais e notícias publicadas na mídia. Os resultados alcançados mostram que a autodeterminação informativa é um direito que, para concretização, exige elementos que lhe sustentem. A conclusão identifica que o princípio da segurança é um desses baluartes a ponto de se tornar a condição sine qua non para a efetivação do direito à autodeterminação informativa. O artigo apresenta sugestões para o fortalecimento dessa rede de apoio.
O presente artigo objetiva discutir o direito de personalidade e fundamental privacidade, bem como a proteção de dados em tempos de crise extrema, como a atual que envolve a epidemia da Covid-19. O estudo que se estrutura em cinco etapas, tem como referencial teórico o pensamento de Heinrich Hubmann e Heinrich Henkel que desenvolveram a Teoria dos Círculos Concêntricos e Fulgenio Madrid Conesa, responsável pela Teoria do Mosaico. A conclusão do trabalho indica que é possível equilibrar o direito à privacidade e proteção de dados pessoais com a necessidade do Estado em obter informações dos seus cidadãos para os proteger em períodos de anormalidade. Para tanto propõe a utilização da Teoria da Fração Ideal, desenvolvida pelos autores, a fim de estabelecer uma estrutura de limites quando da captação de dados. O método utilizado é o hipotético dedutivo e a metodologia se concentra na revisão bibliográfica de doutrina, legislação, artigos científicos e consulta a sites de órgãos oficiais.
