A cidadania e a latinidade sempre foram temas muito próximos quando se trata da Roma antiga. Observase que o status jurídico dos latinos era bastante diferenciado daquele dos demais não romanos. Devido ao seu particular status em relação ao sistema jurídico romano, as fontes e a doutrina sobre o tema evidenciam o não enquadramento dos latinos como peregrini. A particular relação desenvolvida entre romanos e latinos durante toda a existência de Roma teve bases culturais muito antigas, presentes na própria origem latina da cidade romana. O vínculo cultural e jurídico desenvolvido entre Roma e os demais latinos foi afetado por conta das guerras latinas, mas nunca foi apagado do sistema jurídico romano. A experiência romana de ius civitatis denota um diferente conceito de cidadania em relação àquela proposta pelo modelo do Estado-nação, abrindo possibilidades para uma concepção intermediária entre o cidadão e o estrangeiro. PALAVRAS-CHAVES:Cidadãos. Latinos. Roma antiga. ABSTRACTThe themes of Citizenship and Latinity have always been very closely linked when it comes to ancient Rome. It is observed that the legal status of Latins was very different from that of other non-Romans. Due to their special status in relation to the Roman legal system, sources and doctrines on the subject show the inadequacy of the Latins as peregrini. The special relationship developed between the Romans and Latins throughout the existence of Rome, had very old cultural bases, presented in the Latin origin of the Roman city. The cultural and legal link developed among Rome and other Latins was affected because of the Latin wars, but it was never completely removed from the Roman legal system. The Romans' experience of ius civitatis denotes a different concept of citizenship from that proposed by the model of Nation States, opening up possibilities for an intermediary concept between the citizen and the foreigner.

Com esse intuito, estudou-se a experiência jurídica de alguns reinos germânicos, estabelecidos no antigo território do Império Romano, o direito da Igreja, a visão política do Sacro Império Romano Germânico e a influência da Escola de Bolonha. Por meio do método de pesquisa indutivo, observou-se que a tradição romanística atuou em diferentes planos de influência, como fonte primária e subsidiária do direito; transmitindo via costume noções romanas à instituições jurídicas medievais; e influênciou na composição sistêmica de novos sistemas jurídicos.
ResumoNeste artigo questiona-se a identificação do conceito romano de ius gentium com aquele de direito internacional moderno. Para responder o questionamento, busca-se identificar as características do ius que regulava as relações de Roma com outros povos e reis e as situações jurídicas que envolviam os estrangeiros. Observou-se que a aplicação do conceito moderno de direito internacional à antiguidade romana gera a mutilação da realidade histórica e dificulta a compreensão do seu universalismo, em suas especificidades culturais. RESUMO: A concessão de direitos políticos no Brasil tem início durante o período colonial, sendo profundamente modificado durante o Império e a República pelo aguçamento econômico típico do liberalismo. Os movimentos liberal e constitucionalista convergem criando instrumentos de exclusão de parcelas da população do exercício dos direitos políticos, colaborando para a manutenção da tradição ibérica patrimonialista do Estado. O artigo concerne à concepção e dinâmica dos direitos políticos durante o período imperial através da análise da Constituição de 1824, das leis eleitorais imperiais, bem como da doutrina constitucionalista e das correntes políticas da época, evidenciando o contraste dentro do movimento liberal no que tange as restrições ao exercício dos direitos políticos.ABSTRACT: The concession of political rights began in Brazil during the colonial period, being profoundly modified during the Empire and the Republic due to economic sharpening typical of liberalism. The liberal and constitutionalist movements converge creating instruments to exclude portions of the population from exercising political rights, contributing to the maintenance of the Iberian tradition of the patrimonial state. This article concerns the conception and dynamics of political rights during the imperial period through analysis of the 1824 Constitution, the imperial electoral laws, as well as the constitutional doctrine and political currents of the time, depicting the contrast within the liberal movement in terms of the restrictions to the exercise of political rights.
Resumo: O artigo é de cunho historiográfico e analisa as interpretações da doutrina sobre o complexo de normas que constituem o ius fetiale a partir do século XIX, evidenciando as diferentes concepções modernas da relação entre direito e religião na Antiguidade. Como conseqüência dessas teorias, o ius fetiale foi e frequentemente ainda é tratado como estritamente religioso, não sendo reconhecido como direito, como "direito internacional", como "direito público externo", ou como "direito supranacional". Observam-se, nessas linhas, de um lado a pressuposição do conceito de "Estado" e a mutilação da realidade histórica, e de outro a compreensão do universalismo romano nas especificidades da sua cultura. Direito público externo.Abstract: This article is a stamp and analyzes the historiographical interpretations of the doctrine on the set of rules that constitute the ius fetiale from the nineteenth century, highlighting the different conceptions of the modern relationship between law and religion in Antiquity. As a consequence of the theories, ius fetiale was and is still often treated as strictly religious, not being recognized as a right, as "international law", as "foreign public law", or "supranational law." It is observed in these lines from one side to the assumption of the concept of "state" and the mutilation of historical reality, and from the other, the understanding of the Roman universalism, the specificities of their culture.
