Kewenangan pemerintah daerah untuk menetapkan hak ulayat ke dalam peraturan daerah berlandaskan pada Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah serta Peraturan Menteri Negara Agraria/Kepala BPN Nomor 5 Tahun 1999 tentang Pedoman Penyelesaian Masalah Hak Ulayat Masyarakat Hukum Adat, untuk melakukan urusan pertanahan dalam kaitannya dengan hak ulayat yang masih ada di daerah tersebut. Kriteria penentu tentang keberadaan hak ulayat oleh pemerintah daerah meliputi adanya masyarakat hukum adat tertentu, adanya hak ulayat tertentu yang menjadi lingkungan hidup dan tempat mengambil keperluan hidup masyarakat hukum adat itu, dan adanya tatanan hukum adat mengenai pengurusan, penguasaan, dan penggunaan tanah ulayat yang berlaku dan ditaati oleh masyarakat hukum adat itu. Pemerintah daerah dalam menjalankan kewenangannya dengan mengikutsertakan masyarakat hukum adat yang ada di daerah tersebut, pakar hukum adat, LSM, dan instansi yang terkait dengan sumber daya alam. Prosedur penentuan penetapan tanah hak ulayat dalam peraturan daerah tetap mengacu pada pedoman penyusunan peraturan daerah sesuai peraturan perundang-undangan yang berlaku dimana salah satu hal yang penting bahwa dalam setiap pembuatan produk hukum daerah idealnya melampirkan Naskah Akademik yang akan mampu menjelaskan mengenai materi muatan rancangan peraturan daerah, termasuk kerangka pikir serta tujuan adanya peraturan daerah tersebut. Sehingga akan membantu orang banyak untuk dapat memahami pasal-pasal.
Introduction to the Problem: The presence of a chicken farm in the middle of the North Luwu District community settlement has positive and negative impacts which are studied based on the perspective of Islamic business ethics.Purpose/Objective Study: This study aims to analyze the review of Islamic business ethics towards chicken farming in Katulungan Village and to find out the impact arising from chicken farming activities in the middle of the Ketulungan Village community settlement.Design/Methodology/Approach: This research is a qualitative descriptive study. Data was obtained through observation, interviews, and documentation. Furthermore, the data obtained were analyzed using data collection techniques, data reduction, data presentation as well as conclusions and data verification.Findings: The results of the study explain that chicken farms that exist in the midst of community settlements are reviewed based on aspects of Islamic business ethics in the form of the principles of unity, balance/fairness, free will/effort, accountability, and truth, as well as virtue and honesty. Based on these aspects, there are livestock activities that are appropriate and not in accordance with the principles of Islamic business ethics. In addition, the presence of these farms has more negative impacts than positive impacts on the surrounding community.Paper Type: Research Article
Tanggung jawab debitur terhadap kreditur dalam perjanjian jaminan fidusia yaitu Pemberi fidusia dalam hal ini debitur wajib mengurus dan menjaga harta benda, Kewajiban debitur adalah memelihara obyek jaminan fidusia, Pemberi fidusia wajib menyerahkan laporan kepada penerima fidusia, Apabila terjadi kerusakan terhadap barang yang telah dijaminkan maka debitur berkewajiban mengganti barang tersebut dan Kewajiban debitur adalah mengasuransikan obyek jaminan fidusia pada perusahaan asuransi. Sedangkan proses penyelesaian sengketa antara debitur dan kreditur dalam perjanjian jaminan fidusia, apabila terjadi cedera janji (wanprestasi) antara debitur dan kreditur dapat diselesaikan melalui 2(dua) mekanisme yakni; melalui jalur litigasi yang terdiri dari penyelesaian secara perdata melalui musyawarah kedua belah pihak sesuai ketentuan yang termuat dalam akta notaries. jika hal tersebut tidak dapat diselesaikan kedua belah pihak maka proses penyelesaian sengketanya dapat dilanjutkan pada pengadilan negeri tempat domisili hukum tetap. apabila salah satu pihak melalaikan ketentuan dalam akta jaminan fidusia tersebut dapat dilakukan tuntutan pidana sesuai dengan Pasal 35 dan 36 Undang-Undang Nomor 42 Tahun 1999 tentang jaminan fidusia.

The results in this study are the form of implementing the developer's responsibility for fulfilling the rights of BTN housing consumers as follows: the right to obtain information, the right to obtain good housing construction, the right to obtain public facilities provided directly by the developer and the right to obtain insurance coverage.
Legal certainty of a land pawn agreement carried out using customary law in the Tolaki community is guaranteed by the customary law concerned because the dispute resolution that occurs is also resolved through a customary court, and the existence of the decision of the customary court that binds the disputing parties in addition to the application of strict sanctions in dispute resolution. In addition, the existence and existence of customary law is also supported by the provisions of the applicable legislation, which can be seen in Law Number 4 of 2004 concerning The provisions of the Basic Provisions of Judicial Power, in Article 28 paragraph (1) which states "Judges are obliged to explore, follow, and understand legal values and a sense of justice that live in society". The decision issued by the court in case Number: 13/Pdt.G/2013/PN.Unh did not take into account the decision of the customary court on the grounds that the case would be processed in accordance with the applicable positive law and no attempt was made by the plaintiff to withdraw his lawsuit even though a customary trial has been carried out and the customary court has issued its decision.
