This research examines the right of access to justice – fair, effective and timely judicial protection – from the perspective of the American Convention on Human Rights, also known as the Pact of San José of Costa Rica, and Brazilian constitutional norms, verifying wether they protected the right to health in order to realize social justice. Furthermore, this study questiones whether this Pact contributed to the protection of the right to health for Brazilians. In other words, this paper investigates if this international treaty contributed to the promotion of the right to health in Brazil by allowing citizens, through the phenomenon of judicialization of public policies, access to fairer and more effective judicial protection.
A temática da presente pesquisa versa sobre os impactos da aplicação do receituário neoliberal no cenário laboral e socioeconômico dos países da América Latina, notadamente na Argentina, México e Brasil. A pesquisa se propõe a analisar a seguinte problemática: as sucessivas reformas legislativas efetivadas na América Latina se coadunam com os preceitos da garantia dos direitos sociais, notadamente dos laborais? Nesse sentido, o objetivo geral da pesquisa é identificar a maneira como o neoliberalismo rege as relações socioeconômicas no panorama da América Latina e destacar a importância das políticas de geração de trabalho e emprego pautadas na garantia de condições laborais dignas. A técnica de pesquisa consiste na análise crítica das reformas trabalhistas da Argentina, México e Brasil por meio da utilização de material bibliográfico-doutrinário interdisciplinar referente à (des)proteção dos direitos sociais da classe trabalhadora latino-americana. A pesquisa conclui que o neoliberalismo tem influenciado reformas trabalhistas no âmbito da América Latina com caráter precarizante dos direitos humanos e fundamentais, notadamente dos sociais, cenário que impõe a necessidade de mudança de paradigma com o intuito de viabilizar a garantia de um patamar civilizatório mínimo e a efetivação progressiva dos direitos humanos e fundamentais.
Giovanni Pico Della Mirandola desenvolveu a ideia de que o homem pode ascender na cadeia das criaturas pelo exercício de suas capacidades intelectuais o que seria a garantia de dignidade da existência humana na vida terrestre, contribuindo para a compreensão da dignidade da pessoa humana nos pactos internacionais, bem como na Constituição brasileira de 1988. O respeito à dignidade da pessoa humana permite a concretização dos direitos fundamentais sociais dos cidadãos, mas, na atualidade brasileira, tem-se visível afronta à sua fundamentalidade, em especial na área da educação e do trabalho. Houve a aprovação da ‘reforma’ trabalhista (Lei nº 13.467/2017) que esgarçou o sistema juslaboral de proteção e a adoção na educação superior pública da figura do docente voluntário. Tais situações promovem profundo retrocesso social no Estado Democrático de Direito mediante a desconstrução de direitos sociais fundamentais dos cidadãos brasileiros
O artigo traz resultados de pesquisa em que participaram 121 docentes de cursos de Relações Públicas no Brasil, com o objetivo de conhecer desafios e dificuldades do ensino remoto durante a pandemia da Covid-19. Por meio de questionário on-line, os resultados mostraram que, apesar de pouca capacitação, os docentes adaptaram-se à nova realidade on-line, vencendo o desafio do ensino remoto. As dificuldades foram o aumento de horas de trabalho, a readequação do ambiente doméstico e o conhecimento das ferramentas on-line. Na opinião dos docentes, após a pandemia o ensino provavelmente será híbrido, com o uso intensivo de ferramentas digitais.
A integração regional no MERCOSUL não pode mais se limitar a questões comerciais, devendo incluir temas laborais no intuito de reduzir as assimetrias do desenvolvimento econômico. O objetivo desta pesquisa é demonstrar que o retorno da direita conservadora em países mercosulistas está impulsionando o desmonte dos direitos laborais, impossibilitando a continuidade da agenda social no bloco que foi impulsionada pelo regionalismo pós-liberal. São complexos os fatores que envolvem a questão do trabalho assalariado na América Latina, sendo necessário o “transbordamento” do desenvolvimento econômico para as áreas sociais, principalmente envolvendo o labor humano e a migração de trabalhadores. Se o MERCOSUL não priorizar as relações de trabalho, o projeto integracionista não se efetivará em sua plenitude, podendo esvanecer nas próximas décadas.
