Conceitos sobre gênero e diversidade: um desafi o para a sociedade e o direito Concepts About Gender and Diversity: A Challenge for Society and The Law Conceptos sobre género y diversidad: un desafío para la sociedad y el derecho O livro Direitos LGBT: aLGBTfobia estrutural e a diversidade sexual e de gênero no direito brasileiro (2019) é resultado da dissertação de mestrado em direito, realizado na Universidade Federal de Minas Gerais, por Caio Benevides Pedra, professor, advogado, ativista em direitos humanos e pesquisador de questões relacionadas à cidadania da população LGBT.A partir da análise da atuação do Estado e do Direito na garantia de direitos a essa população, o volume objetiva facilitar a compreensão de quatro conceitos introdutórios e fundamentais para os debates atuais sobre gênero e diversidade: identidade de gênero, expressão de gênero, orientação sexual e sexo biológico, pois, diante das divergências que se apresentam na sociedade e no mundo jurídico, a compreensão desses conceitos possibilita uma atuação mais adequada dos operadores do Direito, no Brasil.Na introdução, Caio Benevides Pedra (2019) destaca que exclusões e discriminações sofridas pela população LGBT em nosso país decorrem de uma LGBTfobia estrutural e que os direitos assegurados a esses grupos ao longo do tempo não se originaram do Legislativo, mas do Executivo e, majoritariamente, do Judiciário, apesar das dificuldades. Considerando essa realidade, o estudioso organiza a discussão em três capítulos além das considerações finais.No primeiro capítulo -"A LGBTfobia estrutural no Brasil" -, se ocupa em demonstrar a existência da LGBTfobia e, para tanto, chama a atenção para o fato de que padrões sociais separam pessoas em dois grupos: os que são aceitos e os demais. Esses últimos sofrem práticas discriminatórias que lhes negam acesso aos direitos fundamentais positivados na Constituição Federal de 1988. Entre essas práticas estão as violências físicas, verbais, morais e psicológicas que são praticadas por indivíduos, grupos ou instituições, e os discursos de ódio que violam princípios como igualdade, liberdade e dignidade humana da população LGBT. A naturalização dessas discriminações é que lhes dá o caráter estrutural.
Nos Estados latino-americanos, marcados majoritariamente por profunda desigualdade social, o acesso à justiça reveste-se de especial importância, uma vez que é principalmente por meio dele que se busca a efetivação dos demais direitos humanos. Com este trabalho objetivou-se analisar os relatórios de mérito emanados da Comissão Interamericana de Direitos Humanos (CIDH) em que o Brasil foi parte, para evidenciar sob quais fundamentos há violação do acesso à justiça neste país. Partindo desta reflexão, correlacionaram-se os resultados de pesquisa feita pelo Núcleo de Pesquisa em Direitos Humanos, Estado e Políticas Públicas do Programa de Pós-Graduação em Ciências Sociais Aplicadas da Universidade Estadual de Ponta Grossa. Referida pesquisa desenvolveu-se de forma mista (quantitativa e qualitativa), de agosto a novembro de 2018, sendo um estudo de caso, através do qual coletaram-se dados sobre ações, projetos ou programas existentes em Ponta Grossa que proporcionam acesso à justiça à população local. Neste trabalho adotou-se o método dedutivo. Os procedimentos metodológicos foram pesquisa bibliográfica, documental e formulário de entrevista. Dos relatórios analisados constatou-se que a violação do acesso à justiça suscitada perante a CIDH refere-se primordialmente a homicídios consumados ou tentados, praticados majoritariamente por policiais, sob a predominância de dois fundamentos: morosidade de tramitação processual e falha na coleta de provas. No tocante a pesquisa desenvolvida em Ponta Grossa, verificou-se inexistência de qualquer ação, projeto ou programa que vise coibir as violações apuradas nos relatórios. Concluiu-se pela necessidade de criação de mecanismos eficazes para coibição dessas práticas, bem como superação de profundas desigualdades políticas e sociais.
