La publicación de revistas jurídicas es una práctica generalizada y bicentenaria en América Latina. Sin embargo, es muy poco lo que sabemos sobre las políticas editoriales que han adoptado las revistas jurídicas en la región. No se cuenta con información clara sobre el tipo de procedimientos, criterios y decisiones que deben esperar los estudiosos del derecho para publicar sus trabajos. Después de reflexionar sobre las principales discusiones y aproximaciones sobre el tema, este trabajo avanza la cuestión presentando información sistematizada sobre poco más de setecientas revistas jurídicas que se publican periódicamente en la región, así como los lugares y años en que fueron fundadas. Los datos sirven para describir los formatos y tiempos en que estas publicaciones son puestas a disposición del público, así como también, explica la estructura y procedimiento seguido por estas publicaciones para determinar qué se publica y qué no. De esta manera, intentamos ofrecer una representación estadístico-descriptiva de las principales características de los formatos, criterios, procedimientos y prácticas públicas y explícitas que dan sustento adjetivo y material a las revistas jurídicas en América Latina.
La pandemia puso a prueba el funcionamiento de las democracias constitucionales en diversas partes del mundo. El objetivo de este volumen es contribuir a la comprensión de las repercusiones de la emergencia sanitaria por COVID-19 en el Estado de derecho mexicano. Las reflexiones aquí fomentadas subrayan la importancia de la aplicación del derecho convencional por parte del Estado en la gestión la pandemia, junto a la necesidad de que existan contrapesos y controles constitucionales respecto de las medidas impulsadas por el Gobierno para afrontar la emergencia. Proponen un diagnóstico sobre la capacidad de respuesta del sistema federal mexicano para contener la propagación del virus y proteger a la población más vulnerable. Destacan los esfuerzos institucionales a fin de garantizar la participación política ciudadana y la renovación pacífica, libre y ordenada de los órganos de representación popular en contextos extraordinarios. Finalmente, centran la atención en la creciente militarización del país que, si bien tiene un origen anterior, durante la pandemia se ha profundizado, ampliado y diversificado, lo que pone en riesgo los derechos humanos y la naturaleza democrática del Estado.
Cuando los marcos que definen los estados democráticos de derecho resultan insuficientes, se torna primordial repensar de qué manera generar mejores condiciones para una sociedad cansada de la inacción de sus autoridades. Este artículo plantea algunas reflexiones y expone dos ejemplos respecto al rol que juegan aquellos actores jurídicos cuyas labores, por lo general, suelen pasar desapercibidas para los sistemas políticos en los que se insertan; es decir, las personas que ejercen la abogacía. Sin embargo, no refiere cualquier tipo de abogacía sino a uno particularmente comprometida con la acción social en aras de fortalecer las reglas e instituciones que sostienen a las democracias.
