La pandemia puso a prueba el funcionamiento de las democracias constitucionales en diversas partes del mundo. El objetivo de este volumen es contribuir a la comprensión de las repercusiones de la emergencia sanitaria por COVID-19 en el Estado de derecho mexicano. Las reflexiones aquí fomentadas subrayan la importancia de la aplicación del derecho convencional por parte del Estado en la gestión la pandemia, junto a la necesidad de que existan contrapesos y controles constitucionales respecto de las medidas impulsadas por el Gobierno para afrontar la emergencia. Proponen un diagnóstico sobre la capacidad de respuesta del sistema federal mexicano para contener la propagación del virus y proteger a la población más vulnerable. Destacan los esfuerzos institucionales a fin de garantizar la participación política ciudadana y la renovación pacífica, libre y ordenada de los órganos de representación popular en contextos extraordinarios. Finalmente, centran la atención en la creciente militarización del país que, si bien tiene un origen anterior, durante la pandemia se ha profundizado, ampliado y diversificado, lo que pone en riesgo los derechos humanos y la naturaleza democrática del Estado.
ReSumen: Este artículo ofrece un diagnóstico de la protección jurisdiccional del derecho a integrar las autoridades electorales locales, incluido en la Ley a partir de la reforma electoral de 2008. Presenta además, una explicación de los diversos mecanismos de control que existen para conocer de los procesos de renovación de los órganos electorales de las entidades federativas. El objetivo del ensayo es reconstruir el contenido y alcances de este derecho, a través de las resoluciones del Tribunal Electoral, señalando las coordenadas esenciales para entenderlo; asimismo, se ofrecen algunos cuestionamientos a las argumentaciones que los jueces electorales han utilizado para conocer de él. Prácticamente no existe en la literatura mexicana trabajos que se ocupen del derecho a integrar las autoridades electorales, por lo que este artículo representa un primer esbozo en la comprensión del tema.
