En junio de 2011 se publicó una importante reforma constitucional en México. Con ella cambiaron la mayoría de las disposiciones dedicadas a los derechos humanos y se reafirmó la apertura del ordenamiento jurídico mexicano al derecho internacional. En este texto se ofrece una reconstrucción de algunas de las decisiones y procesos que están detrás de la reforma y se delinea un mapa de las acciones que los diferentes actores políticos, jurídicos y sociales deberán llevar a cabo para convertir lo que las nuevas normas prometen en una realidad.
RESUMEN.En este ensayo se sostiene la pertinencia teórica de distinguir entre el neoconstitucionalismo y el garantismo. Ambas aproximaciones teóricas estudian el mismo modelo de organización político/jurídica: el constitucionalismo democrático. Esto ha provocado que diversos estudiosos europeos y latinoamericanos confundan las dos aproximaciones y utilicen ambas categorías de manera indistinta. Sin embargo, en el texto se sostiene que el garantismo es una teoría que debe adscribirse al positivismo jurídico mientras el neoconstitucionalismo (que, en realidad, es una categoría que conjuga diferentes teorías) tiene una tendencia iusnaturalista. Esta diferencia fundamental tiene implicaciones teóricas relevantes y también consecuencias prácticas sobre todo en el ámbito de la justicia constitucional.Palabras clave: Ferrajoli, neoconstitucionalismo, galantismo, justicia constitu cional.ABSTRACT. The essay advances the theoretical relevance of distinguishing between two legal approaches: Neo-constitutionalism and Garantismo. Both theories are interested in the same model of political and legal organization, that is, democratic constitutionalism. This has produced confusions among European and Latin American scholars, who tend to use both categories indistinctively. However, the author argues that whereas garantismo is an expression of legal positivism, neo-constitutionalism not. This basic difference has many theoretical consequences and some practical implications in the realm of judicial interpretation of constitutional norms.
En el artículo se aprecia el manejo de dos premisas fundamentales: lo sencillo pero denso y complejo de las frases de Norberto Bobbio, y la doble cara de un mismo fenómeno: el derecho y el poder, lo que puede ser considerado como el método bobbiano de estudio de conceptos frontera en su bidimensionalidad. El autor centra su análisis principalmente en el fenómeno jurídico y pone en relación el constitucionalismo de los derechos con el método democrático en el sentido de determinar quién tiene la última palabra sobre cuestiones relacionadas con los derechos fundamentales, el constitucionalismo fuerte o la democracia radical. Termina el autor recuperando la teoría sobre la democracia de Bobbio, evidenciando la naturaleza esencialmente constitucional de la misma.
<p> </p><p><span> </span>En el siguiente artículo, el autor reflexiona en torno al retroceso autoritario en las democracias latinoamericanas. El texto plantea dos modelos bifurcados: “democracia elitista” y “progrepopulismo”. El primero apuesta por una sociedad jerarquizada y el segundo opera con una movilización popular pero incorporando liderazgos fuertes. El autor traza una cartografía conceptual que señala el avance de los Estados de la región hacia estos dos paradigmas, siendo ambos alternativas extremas; sólo por excepción estos se perfilan al constitucionalismo democrático. Asimismo, se destacan las instituciones prototípicas en el diseño de la democracia constitucional que ha sido paulatinamente abandonada y desfondada por estos países.</p>
