O presente estudo tem como objeto a análise de uma decisão recente e inédita no país que proporcionou uma nova interpretação da questão da punibilidade indígena. Trata-se de acórdão confirmatório pela segunda instância do Tribunal de Justiça de Roraima de sentença de juiz de primeiro grau realizada nos autos do Processo Nº 0090.10.000302-0. Inicialmente, é feita uma abordagem introdutória relacionando Direito Penal, Cultura e Poder. Em seguida, é abordada a nova valorização da cultura indígena como fruto de uma visão multiculturalista consagrada pela Constituição Federal de 1988.Após, analisa-se superficialmente a resposta penal como fruto de uma manifestação cultural, inclusive na própria tarefa de interpretação do Estatuto do Índio no direito penal ordinário e, no caso em análise, a punição do índio pela comunidade indígena Monoá à luz da Convenção 169 da OIT, tratado de direitos humanos que o Brasil é signatário. Busca-se compreender juridicamente como tal decisão se fundamenta inclusive com paralelos no direito comparado. Por meio de uma metodologia qualitativa baseada em pesquisa bibliográfica, analisa-se, portanto, uma decisão inédita através do reconhecimento intercultural que implicou em um dos direitos fundamentais mais importantes do indivíduo: a liberdade.
O presente estudo tem como objeto a análise das decisões pelo STF do Habeas Corpus126.292 SP e Ações Declaratórias de Constitucionalidade nº 43 e 44, as quais provocaramintenso debate jurídico, à luz da teoria do estado de exceção. Tais decisões possibilitaram aexecução provisória de pena após condenação de segundo grau pelo Poder Judiciário, mesmopendente recurso a tribunal superior, sem necessidade de apurar possível prisão cautelar, jáprevista no ordenamento. Questiona-se se tal decisão não viola expressamente a norma depresunção de inocência prevista no artigo 5º, inciso LVII da Constituição Federal de 1988.Busca-se verificar se a decisão guarda relação com o contexto político e econômico que o paíspassou a viver após as manifestações de junho de 2013. Em seguida, é feita uma abordagemlegal e doutrinária das decisões dos ministros sobre as decisões mencionadas. Analisa-se ospensamentos de Carl Schimitt, Walter Benjamin e Giorgio Agambem sobre estado de exceção.É feita uma abordagem, trazendo um paralelo das principais idéias destes pensadores com aquestão da prisão penal automática após condenação de segundo grau. A pesquisa foirealizada por meio de estudo bibliográfico. Trata-se de decisão polêmica que mudouentendimento pacificado pelo próprio STF em 2009.
