A la responsabilidad civil dedica el Código civil los arts. 1.902 a 1.910, que son objeto de una constante aplicación por la jurisprudencia, hasta el punto de hacer de la responsabilidad civil uno de los sectores más vivos del ordenamiento jurídico. El sistema del Código civil está basado, fundamentalmente, en la culpa del sujeto llamado a responder del daño causado. Sin embargo, la interpretación de las normas del Código civil ha experimentado una importante evolución como consecuencia del nuevo enfoque de la responsabilidad civil, que atiende, sobre todo, a la necesidad de proteger la persona y sus bienes jurídicos 1 • El legislador no ha sido tampoco ajeno a este cambio de mentalidad, como se demuestra por la continua introducción de regímenes especiales de responsabilidad, en los que se ignora la culpa con la finalidad de facilitar la indemnización del daño causado 2 • La responsabilidad civil es también objeto de tratamiento por el Código penal, siendo posible afirmar la existencia de una doble regulación en nuestro ordenamiento jurídico. Actualmente, la regulación de la materia en este Código se encuentra dividida: por un lado, en el Capítulo II, Título II, Libro I, encontramos los preceptos referidos a los sujetos responsables de los delitos o faltas (arts. 19 a 22); por otro, tenemos el Título IV del Libro I dedicado al contenido de la responsabilidad civil (arts. 101 a 111); y, finalmente, la extinción de la responsabilidad es prevista por el art. 117, dentro del Título V del Libro I, donde se efectúa 1.996, como responsabilidades civiles independientes de la culpa establecidas por la ley: a) accidentes de circulación; b) navegación aérea; e) accidentes nucleares; d) accidentes de caza; e) daños derivados del consumo de bienes o la utilización de productos o servicios; f) responsabilidad patrimonial de las Administraciones públicas, y la de sus concesionarios y contratistas, por los daños derivados del «funcionamiento normal o anormal de los servicios públicos»; y g) responsabilidad del Estado por los daños causados por error judicial o funcionamiento anormal de la Administración de Justicia. 265
El ensayo clínico constituye una de las piedras angulares de la investigación biomédica. De hecho, son necesarios para la autorización de nuevos medicamentos o para nuevas indicaciones terapéuticas de los que ya están siendo comercializados. De los ensayos clínicos dependen, además, buena parte del avance científico y de la mejora en la asistencia sanitaria. Aunque estadísticamente no son muy frecuentes, los daños en ensayos clínicos sí son muy mediáticos, saltando a un primer plano de la actualidad cada vez que se producen muertes o lesiones graves de los participantes. Se pone así de manifiesto, en un par de ejemplos recientes, la tensión y el difícil equilibrio entre la seguridad de los sujetos de ensayo y la necesidad de utilizar una metodología irrenunciable para progresar en el tratamiento de las enfermedades. Nos referimos, en primer lugar, al caso Bial, que ocurre en Francia a principios de 2016. Tras la previa experimentación en chimpancés, se estaban desarrollando desde mediados de 2015 en las instalaciones de la empresa privada Biotrial, con sede en Rennes, ensayos de un medicamento para combatir cambios de ánimo y distorsiones motoras que aparecen en enfermedades degenerativas. El ensayo se econtraba en fase I, realizándose con voluntarios sanos que sufrieron accidentes cerebrales con necrosis y hemorragias profundas, llegando a fallecer un participante. En el segundo caso, en julio de 2018 se paraliza en Holanda un ensayo clínico con Viagra en embarazadas tras la muerte de 11 bebés. Las madres habían recibido durante el embarazo sildenafilo para favorecer el crecimiento de la placenta. La prueba se inició en 2015 y participaron 183 gestantes (93 tomaron Viagra, 90 un placebo). El sildenafilo dilata los vasos sanguíneos y se utiliza la mejorar la erección masculina, y los médicos esperaban que aumentara el flujo de sangre en la placenta, haciendo que prospere el feto, pero ahora se teme, a la espera del resultado de la investigación, que el sildenafilo haya incrementado la presión sanguínea en los pulmones, reduciendo el oxígeno. En definitiva, vemos que, pese al riguroso control burocrático (autorización administrativa, consideración riesgo/beneficio, consentimiento informado, cumplimiento de la Buena Práctica Clínica, progresión por fases, etc.), los daños se producen, por lo que es tarea del ordenamiento jurídico dar una adecuada protección a los sujetos de ensayo. Aquí es donde entra en juego el instrumento técnico de la responsabilidad civil, canalizándose a través de ella las demandas de quienes han sido perjudicados por su participación en el ensayo.
A COVID-19 é a primeira crise contemporânea de saúde pública com potencial para sobrecarregar o sistema público de saúde mundial. A assistência à saúde é um recurso da sociedade compartilhada e, portanto, os princípios éticos que orientam seu racionamento exigem que serviços, medicamentos e equipamentos sejam aplicados onde forem mais eficazes, o que prioriza os pacientes com maior probabilidade de se beneficiar do tratamento. Os prestadores de serviços de saúde tomam decisões racionais com recursos escassos e merecem uma liberdade considerável para as suas deliberações de boa-fé, guiadas por estruturas éticas estabelecidas. O padrão de atendimento adequadamente aplicado sofre modulação em sua aplicação, o que requer uma mitigação da responsabilidade civil médica dentro de certos parâmetros objetivos. A lógica normativa é fundamentada no princípio da reciprocidade. Quando a sociedade pede que alguns de seus membros corram grandes riscos pessoais ao servir os interesses do público, é razoável esperar que a sociedade assuma algumas responsabilidades por eles em troca dos riscos assumidos. É apropriado que os formuladores de políticas públicas articulem padrões de atendimento especiais para desastres em massa, como a COVID-19. O objetivo do artigo é identificar como, no Brasil, Portugal e Espanha, a objetiva alteração das circunstâncias impôs a adequação da análise judicial de padrões de conduta profissionais a um panorama de calamidade.
ResumenLa escasez crónica de órganos ha determinado que su donación por personas vivas -uno de los grandes avances de la Medicina-se convierta hoy en día en una importante fuente para los trasplantes (riñones, partes de hígado, pulmones, páncreas, intestinos, etc.). La donación en vida produce resultados superiores para el receptor en comparación con la donación post-mortem: tiempos de espera más cortos y mejor calidad de vida y de supervivencia en el receptor. Como consecuencia de sus acreditadas ventajas, muchos países han admitido la donación en vida, que es asimismo considerada como moralmente aceptable. En España, la nueva Ley de Jurisdicción Voluntaria de 2015 regula el expediente de extracción de órganos de personas vivas. La ley española establece, al igual que las regulaciones de otros países, que la declaración del consentimiento del donante sea formulada bajo supervisión y con aprobación de un juez; esta intervención judicial se dirige esencialmente a garantizar el consentimiento del donante libre, informado y desinteresado. AbstractThe chronical shortage of organs has made that living organ donation (LOD) -one of greatest advances in medical history -emerges as an important source of trasplant (kidneys, parts of liver, lungs, pancreas, intestines, etc.). LOD produces superior outcomes for the recipient compared to the diseased donation: shorter waiting times, better recipient survival and quality of life. As a result of its demostrated advantages, many countries have implemented LOD, that is also considered as morally justified. In Spain, the new Voluntary Jurisdiction Act of 2015 regulates the proceeding to extract organs from living donors. Spanish law provides, like that of other countries, that the statement of the donor's consent should be formulated under the supervisión and with the approval of a Judge; this judicial intervention is intended substantially to ensure the free, informed and non-profit donor´s consent. This paper studies this case of voluntary jurisdiction.
