Este artículo aborda la cuestión respecto de si la teoría del equilibrio de poderes constituye<br />un soporte epistemológico que contribuya de manera real y efectiva a la superación de la<br />problemática suscitada por la prevalencia del poder del alto tribunal de lo constitucional en<br />Colombia. A través del análisis de algunos fallos, se muestra que, en Colombia, la última<br />palabra respecto de asuntos de trascendencia para la vida nacional es pronunciada por el juez constitucional, quien ha asumido como propias competencias que, por mandato constitucional<br />o legal, son de las otras ramas del poder público. Para solucionar la afectación del orden político<br />que genera este hecho, se apela a la teoría del equilibrio de poderes; sin embargo, en la práctica,<br />esta teoría evidencia limitaciones, de cuyo análisis se ocupa el texto. En su lugar, se propone<br />hablar de armonía del poder, en el que las diferencias se acoplan y concurren hacia una finalidad<br />común.
El ethos es comprendido como la capacidad que tiene todo hombre de discernir, reflexionar y, a su vez, de lograr dimensionar cada acto humano, lo cual evidencia que es una persona con carácter, es decir, con una forma de ser, de ver, cuestionar y enfrentarse al mundo, no de cualquier manera, sino conscientemente de quien es y de lo que quiere hacer. Es, tal como lo expresa Santo Tomás de Aquino, "Un ser que está llamado a hacer el bien y que cuenta para ello con su voluntad, la cual será el medio a través del cual, podrá lograr la consecución de ese bien, dado que, es lo que puede ser conseguido gracias a esa potencia del alma ya mencionóda, su voluntad" (S. Th, I-II, q 8, art. 1).
