Este artigo tem como propósito apresentar as análises e resultados obtidos a partir do desenvolvimento de duas pesquisas cujo objetivo em comum foi conhecer, a partir da temática da Guerra do Paraguai, como o Brasil e os brasileiros estão sendo representados em museus e espaços de memória no Paraguai e no Uruguai. A partir da perspectiva teórica de Serge Moscovici, da Teoria das Representações Sociais, foram analisadas as seguintes instituições escolhidas para os estudos: o Panteão Nacional dos Heróis e o Instituto de História e Museu Militar, localizados na cidade de Assunção, no Paraguai, e o Museu Histórico Nacional do Uruguai e o Museu Histórico Cabildo de Montevideo, ambos situados na capital uruguaia. A metodologia utilizada foi a de análise de conteúdo, tanto das exposições através de visitas de campo quanto das informações e dados coletados, aliados a uma revisão da literatura sobre o tema. Dos resultados encontrados, destaca-se no Paraguai uma representação social muito forte de valorização e enaltecimento dos heróis que lutaram e deram a vida pela pátria durante o conflito. Já no Uruguai, constatou-se que a Guerra é entendida como um episódio da história do país cuja representação social é marcada por certa negatividade e arrependimento pela participação no conflito. Em um paralelo comum, destaca-se em ambos os países uma culpabilização do Brasil pelos acontecimentos, observada especialmente nas entrelinhas e ausências dos discursos nos quais as representações sociais se manifestam.
A repatriação se refere a transferência de bens culturais entre países frente a um contexto de reivindicação. As discussões sobre o tema partem de duas perspectivas: a do internacionalismo cultural e do nacionalismo cultural, abordadas aqui a partir do caso dos Mármores do Partenon, em disputa entre a Grécia e a Inglaterra. A partir de uma análise da bibliografia sobre o tema, objetiva-se evidenciar como a divergência entre tais narrativas determinam os impasses existentes no que se refere à repatriação de bens culturais como esses.
RESUMO Este artigo objetiva discutir os fatores extrajurídicos que determinam a repatriação de bens culturais aos seus países de origem, especialmente à luz do caso do canhão El Cristiano. Esse bem, que compõe a cultura material da Guerra do Paraguai (1864-1870), foi capturado como troféu de guerra pelo Exército Brasileiro e trazido do Paraguai ao Brasil, onde integra o acervo do Museu Histórico Nacional. Em 2010 o governo brasileiro deu início ao processo de repatriação de El Cristiano ao Paraguai. Porém, mais de dez anos depois, a devolução ainda não foi concretizada. A partir da análise dos documentos produzidos nesse processo e à luz de teóricos do campo do patrimônio cultural e do direito, sob uma perspectiva interdisciplinar, foi possível identificar que as diferentes imaterialidades que perpassam esse bem material são responsáveis pelo impasse instaurado em torno de sua repatriação. Tais imaterialidades são as memórias, os valores e os discursos que são acionados por retóricas holistas dos dois países e legitimam tanto a reivindicação do El Cristiano como a defesa de sua permanência no Brasil.
