O artigo examina o regime constitucional do controle externo da regularidade dos contratos da administração pública, discutindo quais são os limites das competências do Legislativo e do Tribunal de Contas, especialmente para a sustação de contratos. The article examines the constitutional regime of the external control of government contracts, discussing what are the limits to the competences of the Legislative bodies and the audit courts, especially with regard to the suspension of contracts.
RESUMOO objetivo do artigo é testar a fidelidade do regulador administrativo às normas legais que deveriam limitá-lo, em situação de divergência entre a visão do regulador e o conteúdo das leis. Para a análise jurídica da extensão da competência regulamentar administrativa, o artigo afasta a discussão circunscrita à interpretação do princípio constitucional da legalidade e empreende o exame dos dispositivos legais que conferem atribuições normativas administrativas. O caso escolhido foi a resolução da Agência Nacional de Cinema - ANCINE que estendeu a empresas estrangeiras restrição que a lei fizera incidir apenas sobre empresas com sede no Brasil. ABSTRACTThis article tests the administrative regulator’s fidelity to the legal limits for his actions when there is discrepancy between what he wants to do and what a legal norm allows him to. For the legal analysis of this regulatory competence´s extent, the article moves away from uptakes on the constitutional principle of legality and exams legal dispositions that attributes normative competence to public administration. The case studied is an administrative resolution edited by the National Film Regulatory Agency – ANCINE, in which the agency extended to foreign companies a restriction legally intended only for companies with head offices in Brazil. The article’s finding is the administrative regulator’s conscious infidelity to legality.
O artigo discute, com base na Lei nº 9.277, de 10 de maio de 1996, a possibilidade da União delegar à Estados, Municípios e Distrito Federal a administração e exploração de rodovias federais. Nesse ínterim, os autores trazem a peculiaridade da concessão da exploração à particulares de rodovias não pelo titutal (União) e, por conseguinte, se a União possui responsabilidades incidentes na relação de concessão.
<p>Are there exorbitant clauses in administrative contracts?</p><p> </p><p>RESUMO</p><p>O estudo questiona a narrativa segundo a qual, no direito positivo brasileiro, existiria um regime jurídico de exorbitância a favorecer a posição da administração pública em seus contratos, algo sem paralelo no direito contratual comum. A conclusão apresentada é a de que as chamadas cláusulas exorbitantes dos contratos administrativos, na prática, não são excepcionais, como sugere sua previsão em lei, de modo que não conferem poderes extraordinários à administração pública contratante. As prerrogativas conferidas à administração pela lei de contratações públicas são semelhantes à posição normal dos contratantes nas relações contratuais estabelecidas exclusivamente entre particulares.</p><p> </p><p>ABSTRACT</p><p>This work questions the understanding that Brazilian statutory law would set forth privilege clauses favoring Public Administration in public contracts, which would be unparalleled in common civil contracts. The conclusion presented is that the so-called privilege clauses are in practice not exceptional as statutory law suggests since they do not convey extraordinary powers to Public Administration as contracting party. These powers conveyed to Public Administration by statutory legislation regarding public contract are indeed similar to powers set in some contracts executed between private parties.</p>
