La pandemia generada por la propagación del virus SARS-CoV-2 demandó que los gobiernos instrumentaran una serie de medidas orientadas a la protección de la salud de las personas, así como políticas fiscales, monetarias y laborales para estimular la economía y el empleo. En este trabajo, a través del método de derecho comparado, se efectúa un análisis descriptivo de las medidas adoptadas en China, Italia, España, Francia, Alemania, Estados Unidos de Norteamérica y México, con el objeto de calibrar si responden a las innovaciones que el Constitucionalismo más allá del Estado de Luigi Ferrajoli busca introducir en el paradigma constitucional.
El presente trabajo tiene como propósito plantear la hipotética construcción del derecho fundamental al desarrollo social libre de corrupción, para constituirse como un intento de superación académica de las nociones de derecho al desarrollo, al desarrollo social, al desarrollo duradero, al desarrollo sostenible y al desarrollo sustentable, así como de la representación gráfica de la corrupción propuesta por Robert Klitgaard, mediante un esquema que propone integrar las funciones del Estado, las obligaciones de las autoridades en materia de derechos humanos, el derecho de acceso a la información pública, la rendición de cuentas y la coordinación entre las autoridades de los órdenes de gobierno competentes en la prevención, detección y sanción de responsabilidades administrativas y hechos de corrupción, así como en la fiscalización y control de recursos públicos, y las responsabilidades de los servidores públicos.
El presente trabajo explora la ciberdelincuencia desde un punto de vista hermenéutico y conceptual. Analiza las políticas públicas y legislación que en materia de sociedad de la información y ciberseguridad se han implementado en México; así como la jurisprudencia que se ha emitido respecto a la colisión entre libertades fundamentales y el uso indiscriminado de la informática. Su propósito es presentar el panorama epistemológico para el entendimiento de la delincuencia informática, ante la posibilidad de que México pueda adherirse a la Convención de Budapest.
La protección de datos personales en el ámbito político-electoral mexicano se sustenta en un régimen jurídico amplio, que garantiza el registro de los ciudadanos como electores y su derecho a participar como candidato; promueve su libertad individual y voluntad para afiliarse a un partido político, así como brindar su apoyo ciudadano a quienes aspiren a ser candidatos independientes; sin embargo, establece también prohibiciones y sanciones por la dispersión ilegal del padrón electoral. En este texto se exponen los alcances y límites de la legislación mexicana y la jurisprudencia emitida por el Tribunal Electoral del Poder Judicial de la Federación, así como las experiencias derivadas de casos empíricos, con el fin de establecer que los datos personales en materia político-electoral en México posee diferentes grados de protección.
Resumen: La proyección normativo-positivista de los derechos humanos es insuficiente para su garantía; por eso, para que estos derechos sean exigibles y cercanos a las personas, es pertinente la ampliación teórica del principio de universalidad y del concepto de garantía. En este sentido, más allá de lo que prescriben los sistemas domésticos y regionales para la exigibilidad de los derechos humanos, debemos aludir a la voz consuetus satisdatio que hace referencia a la garantía de los derechos en todo tiempo y lugar para la gestación de un auténtico control de universalidad de los derechos humanos.
