O NOVO CPC, A LEI Nº. 5.478/68 E A CONTAGEM DO PRAZO PARA APRESENTAÇÃO DE DEFESA NAS AÇÕES DE ALIMENTOS – UMA ANÁLISE A PARTIR DOS DIREITOS FUNDAMENTAIS PROCESSUAIS THE NEW CODE OF CIVIL PROCEDURAL, THE LAW Nº. 5.478/68 AND THE DEADLINE COUNT FOR DEFENSE IN ACTIONS REGARDING ALIMONY, CHILD SUPPORT AND PARENTAL SUPPORT – AN ANALYSIS BASED ON FUNDAMENTAL PROCEDURAL RIGHTS Francisco Vieira Lima Neto*Myrna Fernandes Carneiro** Resumo: O novo Código de Processo Civil – CPC/15, de forma inovadora, criou um Capítulo específico para tratar das “ações de família”, composto dos arts. 693 a 699. O parágrafo único do art. 693 expressamente determina a aplicabilidade da lei específica (no caso, Lei nº. 5.478/68) às ações de alimentos e, “no que couber”, as disposições do referido Capítulo. Contudo, o confronto entre o disposto no art. 5º, caput e §1º da Lei nº. 5.478/68 e no art. 695, caput e §1º do CPC/15 suscita dúvida sobre a contagem do prazo para oferecimento de contestação nas ações de alimentos, dúvida esta que o presente artigo propõe que deva ser decidida à luz dos direitos fundamentais processuais garantidos pela Constituição Federal de 1988, não sendo suficiente a mera tentativa de aplicação das antigas regras de solução de antinomias. Abstract: The new Code of Civil Procedural – CPC/15, in an innovative way, created a specific Chapter to address “family actions”, composed of arts. 693 to 699. Article 693’s only paragraph expressly determines the application of the specific law (in case, Law nº. 5.478/68) to actions involving alimony, child support and parental support and, “in what is suitable”, the dispositions of the referred Chapter. However, the confrontation between article 5º, caput and §1º from Law nº. 5.478/68 and article 695, caput and §1º from CPC/15 rises doubt about the deadline count to offer defense in these actions, that this article proposes should be decided according to fundamental procedural rights guaranteed in the Federal Constitution of 1998, and not only by the mere attempt to apply the old rules for resolving apparent conflicts of laws. Resumo: Neste artigo, discute-se o problema da escravidão e da liberdade no Direito Romano. Pretendeu-se abordar o problema do reconhecimento da humanidade do escravo ao mesmo tempo que se estabeleceu a noção jurídica de res. Determinou-se como marcos temporais a consolidação do escravismo na Península Itálica até seu declínio -séculos III a.C. ao II d.C. A pesquisa do problema proposto realizou-se em fontes de Direito Romano: as Institutas, de Gaio, as Regras, de Ulpiano, bem como o Digesto, de Justiniano. Empreendeu-se levantamento historiográfico nas principais bases de referência acadêmica. A metodologia consistiu no confronto das opiniões jurídicas registradas nas fontes escolhidas e as interpretações historiográficas colhidas nas plataformas bibliográficas.Abstract: In this paper, the problems about slavery and liberty in Roman law are discussed. The problems in the recognition of a slave's humanity while stablishing a juridical notion of thing -res. It was determined as time frames the importance of the topic about slavery in the Italian Peninsula until their decline. The research happened in various romans juridical fronts: The Institutes of Gaius, the Rules of Ulpiano and the Justiano's Digest. Various historiographical bases were taken notice as academical references. The methodology consisted in the confrontation between juridical opinions registered in the chosen fonts and interpretations collected in bibliographical platforms.
