En el presente trabajo haremos una breve introducción a la definición de la prisión preventiva (en adelante, PP), junto a una serie de trabajos en los que se la estudia dentro de contextos tres relacionados entre sí: América Latina, Argentina y la Provincia de Buenos Aires (en adelante, PBA). Posteriormente, mencionaremos a dos actores que intervienen en la estructuración del problema de la PP por afuera del Poder Judicial (en adelante, PJ): los medios de comunicación y las autoridades políticas.
Este artículo pretende contribuir, desde un punto de vista sociológico, a entender las dinámicas internas y externas de la justicia penal en Argentina. En este sentido, buscaremos rastrear qué tiene de específico el trabajo de esta última y de qué manera — si esto fuera así— influyen otros actores en la conformación de dicha especificidad. Para ello comenzaremos por mencionar cuales son en la actualidad las disciplinas y actividades que toman a la justicia penal como un objeto de exploración distinto a otros. Luego pasaremos a desarrollar conceptos a partir de los cuales analizar el funcionamiento de instituciones y agencias que están involucrados con el fenómeno penal. Posteriormente señalaremos la importancia de algunas investigaciones pioneras en tanto modelos para la consolidación de una genuina sociología de la justicia penal en nuestro país. Por último, formularemos una serie de preguntas mediante las cuales ubicar a los tribunales penales en un lugar analítico distinto, puesto que estos tribunales necesitan ser investigados como uno de los factores, y no el menos importante, que contribuye a «traducir» determinadas causas sociales en efectos penales específicos.
En el presente artículo procuramos desarrollar algunas conexiones que se observan en Argentina entre la justicia penal y determinados actores extrajudiciales a partir de la utilización del concepto de pánicos morales. En este sentido, señalamos que para hablar de pánicos morales deben estar presentes dos componentes: una preocupación significativa acerca del comportamiento de un grupo o de algún tipo de persona, la cual se convierta en hostilidad hacia quienes hayan sido definidos como una amenaza. Luego proponemos un uso débil del concepto de pánico moral para analizar su vínculo con sucesos asociados a la justicia penal. En tercer lugar, mencionamos la supuesta pérdida de confianza de la sociedad en la justicia, junto a las fuentes de indignación a partir de las cuales parece haberse consolidado dicha indignación. Luego, formulamos la noción de demonios judiciales para brindar algunos puntos de contacto entre pánicos morales y justicia penal. Finalmente, buscamos indagar si los demonios judiciales son un problema “real” para la sociedad o se trata de una construcción llevada a cabo por sectores e instituciones con intereses de por medio.
En este trabajo abordaremos los cambios que generó el surgimiento del proceso de flagrancia en la justicia penal de la provincia de Buenos Aires. Para ello comenzaremos describiendo las características de dicho proceso junto a los presupuestos y objetivos a partir de los cuales se ha fundamentado su implementación. Estos contenidos serán complementados con la evaluación que los actores judiciales hacen sobre el proceso de flagrancia. Posteriormente, analizaremos los argumentos que expresan los mismos actores judiciales para requerir, objetar, aceptar o denegar la utilización de la prisión preventiva en las audiencias que se desarrollan dentro del ya mencionado proceso.
