Resumo A promulgação do Decreto n. 8.058/2013 alterou os procedimentos relativos às investigações antidumping no Brasil. Um dos objetivos do novo decreto, conforme disposto no Plano Brasil Maior (2011), foi o de intensificar a defesa comercial no país, reduzindo-se os prazos de investigação e de concessão de direitos provisórios. Este artigo (i) apresenta fatos estilizados e a agenda de pesquisa sobre medidas antidumping; (ii) mostra a evolução da legislação sobre medidas de defesa comercial no Brasil de 1994 até 2016; (iii) analisa as principais tendências da defesa comercial no Brasil e no mundo a partir da análise das informações do Departamento de Defesa Comercial (Decom) do Ministério do Desenvolvimento, Indústria e Comércio (MDIC) e do Global Antidumping Database do Banco Mundial; e (iv) discute por meio de testes estatísticos e econométricos os efeitos do Decreto n. 8.058/2013 sobre as investigações antidumping no Brasil. Em particular, argumenta-se que (a) o aumento observado no número de investigações abertas não deve ser atribuído ao Decreto n. 8.058/2013, mas à divulgação do Plano Brasil Maior; (b) a taxa de aprovação de medidas não aumentou em decorrência do decreto; e (c) o tempo de investigação se reduziu, mas continua maior do que a comparação internacional.
<p>A Lei 13.019/2014 reformou o marco regulatório dos convênios e parcerias
firmados entre a União e as Entidades Privadas sem Fins Lucrativos (EPSFLs). Este artigo
apresenta os conceitos teóricos das EPSFLs e analisa as estatísticas de prestação de contas
dos convênios e parcerias dessas entidades com a União, disponíveis no Sistema de Gestão de
Convênios e Contratos de Repasse da União (SICONV), de 2008 a 2014. Com base no modelo
econométrico, o artigo mostra que a probabilidade de ocorrência de inadimplência é maior para
as EPSFLs do que para estados, municípios e empresas públicas, o que reforça a hipótese
teórica de falhas voluntárias nas EPSFLs, conforme mostra a Teoria das Três Falhas (Steinberg,
2006).</p>
RESUMOA Resolução nº 18/2005 da Câmara de Comércio Exterior (CAMEX), definiu uma fórmula de cálculo de direito antidumping móvel e variável sobre as importações de PVC-S originárias dos EUA e do México, que vigorou até setembro de 2011. O objetivo desse artigo é analisar os efeitos da aplicação desta fórmula sobre os preços praticados nas importações brasileiras do produto originárias desses países. Utiliza-se um modelo Bertrand para produtos diferenciados e deduz-se os efeitos teóricos da fórmula de cálculo sobre os preços de exportação. As hipóteses previstas pelo modelo são (i) direito antidumping ad valorem reduz o preço de exportação, e (ii) a fórmula definida pela CAMEX aumenta a dispersão do preço de exportação. Utilizandose de base de dados pública e inédita sobre operações de importação individualizadas da Receita Federal, o modelo de regressão confirmou ambas as hipóteses.
