El presente artículo tiene como propósito presentar un análisis teórico sobre factores que inciden en el ejercicio de los derechos ciudadanos y la visibilidad de las personas lesbianas, gays, bisexuales, travestis, transgénero, transexuales e intersexuales (LGBTTTI) en el Estado democrático contemporáneo. Consideramos que a pesar de los avances legales alcanzados, sigue permeando en el imaginario colectivo y en las instituciones públicas un discurso patologizante sobre las personas no heterosexuales, que genera, por parte del Estado, su invisibilización, y por parte de los miembros del colectivo, un aletargamiento en la búsqueda de sus derechos. Sin embargo, las personas, a través de distintos actos performativos, en la cotidianidad van negociando, encontrando espacios, situaciones, personas, contextos en los que consideran viable, seguro y fructífero visibilizarse, ayudando con esto a contrarrestar el discurso patologizante y alcanzar ciertos derechos de ciudadanía plena de forma estratégica y, muchas veces, de forma parcial y temporal.

Los nuevos debates metodológicos dentro de las ciencias sociales apuntan a la superación del antagonismo entre lo cuantitativo y lo cualitativo, y proponen el enfoque mixto, integral o de triangulación; no obstante estas propuestas presentan desaciertos específicamente en dos sentidos: 1) continúa una falta de comprensión del origen epistemológico de cada uno de estos enfoques, lo que conlleva a seguir otorgando un rango secundario a lo cualitativo al momento de pretender integrar ambas metodologías y 2) se considera que las técnicas de recopilación de datos son en sí los métodos cualitativos. Se discurre que parte de estos yerros están relacionados con la escasa enseñanza que se hace de la metodología cualitativa a nivel posgrado.Palabras Clave. Con base en un análisis retrospectivo de lo que han sido las trayectorias de los movimientos en pro de los derechos de las personas lesbianas, gays , bisexuales, travestis, transgénero, transexuales e intersexuales (lgbtti) vinculados a los cambios políticos y económicos globales y, considerando su desarrollo en medio de y como producto de escenarios de violencia y exclusión, el presente artículo tiene como propósito discutir la necesidad estratégica que estos movimientos han tenido de subsumirse a discursos más amplios que, en ocasiones hasta opositores y disidentes del orden, sí han sido reconocidos por el poder dominante, como los discursos comunistas y otros muy legitimados ya como verdades absolutas como el de los derechos humanos, en aras de aparecer en el espacio público y enunciar las discriminaciones, violaciones, negación de derechos e invisibilidad que viven en la vida cotidiana.
Derivado del mapeo del reconocimiento de derechos nacionales a favor de las personas LGBT en América Latina y de la identificación de los mecanismos de aprobación que se han seguido desde el año 2002 hasta el 2021 para el Observatorio de Reformas Políticas en América Latina (REFPOL), se presenta un análisis del papel que han tenido las cortes supremas en la región sobre el reconocimiento de estos derechos a partir del litigio estratégico a causa de derechos humanos que han emprendido colectivos y organizaciones de las poblaciones no heteronormadas ni cisnormadas, como una ruta alterna ante las invisibilizaciones, discriminaciones y violencias que los contextos democráticos nacionales aún continúan ejerciendo sobre estas poblaciones. Cuando la vía de aprobación de derechos LGBT ha sido negada por los Congresos en los países latinoamericanos, la ruta más frecuente a seguir ha sido el litigio estratégico que encuentra cauce positivo cuando los rasgos conservadores de la composición de la Corte están atenuados. Se observa que cuando se logra el reconocimiento de derechos LGBT se contribuye a fisurar el orden patriarcal, heterosexual y cisgénero en el que se asentó tradicionalmente la democracia liberal; no obstante, la vía de acceso para conseguir el derecho a través de las cortes supremas perpetúa la judicialización de derechos de las personas LGBT, lo que no ocurre con las personas heterosexuales cisgénero.
Desde un enfoque crítico a la biopolítica, al cissexismo y la heteronorma se establece una radiografía sobre el avance de derechos LGBT+ a nivel subnacional en México. Este avance ha sido posible gracias a los activismos locales que han iniciado luchas de larga duración y que bajo el amparo de los derechos humanos han encontrado los recursos legales para poder exigir condiciones de vida digna, además de que lentamente han ido consiguiendo espacios dentro de los partidos políticos y cargos de representación popular. Los derechos han sido aprobados a través del legislativo, ejecutivo y tribunales locales o incluso por mandatos de la Suprema Corte, lo que significa que no todos los derechos tienen el mismo estatus legal y algunos de ellos se encuentren en una categoría de incompletos porque aún requieren de juicios.
