Realizing prosperity in the community needs to be supported by a good development management. In the governance system, it is necessary to have governance behaviour that is honest, open, responsible and democratic. In the community structure, a mechanism providing opportunities for the community in the decision-making process for public interests needs to be developed. This study discusses the role of the village head in empowering village communities. This study used a community-based approach so that the community knows in detail concerning the role of the village head in the Framework for the Implementation of Village Autonomy based on Law No. 6 of 2014 concerning Village. The results showed that village head must have a fair and wise attitude in carrying out his duties and obligations. Besides, the village head must give an easy access to the community in providing assistances. Yet, the most important thing is that, as a leader, the village head must be able to provide a good example for their subordinates so as to create maximum results and good community environment.�Mewujudkan kesejahteraan di masyarakat, perlu didukung oleh manajemen pembangunan yang baik. Dalam tatanan tata pemerintahan, perlu untuk memiliki perilaku tata kelola yang jujur, terbuka, bertanggung jawab dan demokratis, sementara dalam tatanan masyarakat suatu mekanisme perlu dikembangkan yang memberikan peluang bagi masyarakat dalam proses pengambilan keputusan untuk kepentingan bersama. studi ini membahas bagaimana peran kepala desa dalam memberdayakan masyarakat pedesaan. Penelitian ini menggunakan metode pendekatan kepada masyarakat sehingga masyarakat tahu lebih detail tentang Peran Kepala Desa dalam Kerangka Pelaksanaan Otonomi Desa Menurut Undang-Undang Nomor 6 tahun 2014 tentang Desa. Hasil penelitian ini yaitu dalam melaksanakan tugas dan kewajiban Kepala Desa mereka harus mempunyai tingkah laku yang adil, bijaksana dan tidak mempersulit dalam memberikan layanan kepada semua masyarakat. Namun yang lebih penting lagi bahwa sebagai seorang pemimpin harus bisa memberikan contoh untuk bawahan sehingga mendapatkan hasil yang maksimal dan terciptanya persatuan komunitas yang baik.
One form of protection of human rights is providing legal assistance. This research discusses the role and position of legal aid institutions from a human rights perspective as well as the role of the state in empowering legal aid institutions as a means of legal protection in society. This study uses a normative research method, in which the data sources used come from literature books, law magazines, legal journals, and other library materials. The conclusion of this research is that legal aid is the most human right of every person and is guaranteed by the laws of Indonesia. In fact, legal aid activities are currently running in accordance with the expectations of the community, as outlined by the provisions of the prevailing laws and regulations. Its functions and roles as law enforcement officers in the field of counseling and information as well as legal reform, until now have been very helpful and seen in the practice of constitutional law in Indonesia. The provision of legal aid as a state obligation to fulfill the constitutional rights of citizens is expanded in Law Number 16 of 2011 concerning Legal Aid by involving not only advocates, but also paralegals, lecturers and law faculty students.
Penelitian ini bertujuan menjelaskan kewenangan Wakil Menteri dalam sistem pemerintahan presidensial Data yang penulis peroleh kemudian diolah dengan tinjauan hukum yaitu dengan analisis langsung terhadap Peraturan Presiden No 60 tahun 2012 Tentang Wakil Menteri dan Undang Undang No 39 tahun 2008 Tentang Kementerian Negara yang kemudian digunakan sebagai bahan hukum primer. Kedudukan Wakil Menteri dalam sistem Presidensial di Indonesia masih mengalami ketidakjelasan dimana dalam Pasal 9 ayat (2) Undang-Undang Nomor 39 Tahun 2008 tentang Kementerian Negara menyebutkan bahwa Kementerian Negara membawahi struktur birokrasi yang terdiri atas, Sekretariat jenderal (Sekjen), Direktorat Jenderal (Dirjen), Ispektorat Jenderal (Irjend), akan tetapi didalam Pasal 1 Peraturan Presiden Nomor 60 Tahun 2012 tentang Wakil Menteri disebutkan bahwa “Wakil Menteri berada dibawah dan bertanggung jawab kepada Menteri”. Keberadaan Peraturan Presiden ini menjadi legitimasi yuridis kedudukan Wakil Menteri saat ini meskipun tidak sejalan dengan Undang-Undang Nomor 39 Tahun 2008 tentang KIementerian Negara. Wakil Menteri diberikan kewenangan melalui Peraturan Presiden Nomor 60 tahun 2012 untuk meringankan beban kerja yang ada pada Kementerian Negara dalam hal ini membantu tugas Menteri yang kemudian disebutkan dalam Pasal 2 ayat (1), Pasal 2 ayat (2) dan Pasal 3 Peraturan Presiden Nomor 60 Tahun 2012 tentang Wakil Menteri. Kewenangan dari jabatan Wakil Menteri terjabarkan dalam beberapa pengkategorian yang didasari oleh beberapa teori kewenangan yaitu jabatan Wakil Menteri yang didasarkan pada jenis kewenangannya (prosedural, substansial, personal dan offisial) dan jabatan Wakil Menteri yang didasarkan pada sumber kewenangannya (atribusi, delegasi dan mandat).
The relationship between the Local Leaders and Deputy Local Leaders often creates conflicts to disharmony. Reduced harmony between the Local Leaders and Deputy Local Leaders occurs in many regions in Indonesia. This study discusses the factors that Cause Disharmony between the Local Leaders and Deputy Local Leaders in the Government System and the Ideal Position of Deputy Local Leaders in the Decentralization System. The data collection method used in this study is library research. Literature research collects relevant data and information by books, magazines, articles, journals, writings, and legislation relating to the issues raised in this study. The research and discussion results in this study are the factors that cause disharmony between the Local Leaders and Deputy Local Leaders in the Local Government System are First, Political Maturity. Second, the unequal distribution of power and race to politicians. While the duties of Deputy Local Leaders regulated in Law No. 23 of 2014 concerning Local Government, where most of the first, assisting Regional Heads in Leading the implementation of local government affairs, Secondly, giving advice and consideration to Local Leaders in carrying out Local Government affairs. Third, carry out the Local Leaders’ daily tasks if the Local Leaders serve a period of detention or temporarily unavailable. Fourth, carry out other duties and authorities by statutory regulations.
Government in administrative law considered as a unit, as an authorized body. Therefore, it is authorized to establish action, according to administrative law, and affect the legal circumstances of others, or to carry out legal action (under the civil law) in the meaning of government bodies legally. Besturen has a functional meaning to means the function of governance, and institutional or structural whole organs of government. Bestuur is an environment outside formation of regulations (regulgeving), and judicature (rechtspraak). The data of this research was collected by library research. This research aims to know the form of legal protection for the people to government action based on the concept of State Administrative Law. The result of this research shows that Legal decisions were those which fulfill formal and material requirements. This was based on the presumptive principle of rechtmatig, that was het vermoeden van rechtmatigheid or presumtio justea causa (every decisions issued by the government or the administrative of the state were considered lawful). This principle means that every decision was not revoked, unless there was a vernietiging of the court closely related to the principle of legal certainty (rechtszekerheidbeginsel).
