Food safety is still not getting the attention it should; therefore the condition of food safety in Indonesia is still a concern. WHO reports that around 2 million of the world’s population die every year due to unsafe food. In Indonesia, Indonesia Agency of Drug and Food Control (BPOM) reported that the outbreak of food poisoning caused the death of 2500 people and as many as 411,500 people sick each year. Food safety is a right for the community but has not been accomplished until now. The study aimed to describe food safety in the protection of the right to health. The research method used was literature review and analysis used descriptive research. The results of the study showed that the condition of food safety in Indonesia still lacks good quality with the number of the outbreak of poisoning cases. Protection of the right to health as regulated in the Health Law Number 36 of 2009 has not been well carried out. Food safety in the protection of the right to health has not been realized because there are still many dangerous food products circulating in the market so that there needs to be strict regulation from stakeholders in protecting the right to health for the community.
Indonesia is a religious welfare state. The 1945 Constitution of Republic of Indonesia as the highest Law Constitution in Indonesia have mandated the fulfilment of citizen's basic needs and civil rights, including health care needs. Therefore, regulations on health field is needed to ensure the fulfilment of their rights to proper health care services. The purpose of this study was to describe the regulations regarding health workers and its inclusion of the principle of legal certainty. Methods: This was a qualitative normative law research using the doctrinal legal approach and statute approach.
The rights to health care were basic rights that were subjected to every person, including people having mental disorders (ODGJ). The ODGJ had the same opportunity to get health services through the mental health facilities, mental health workers, mental health supplies provided by the government. This study aimed to know the regulation on ODGJ's health service rights, the implementation of the protection of ODGJ's rights to health services and the factors affecting the implementation of the protection of ODGJ's rights to health services.
Salah satu tujuan Negara Republik Indonesia sebagaimana tercantum dalam Alinea-4 Mukadimah Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 adalah mencerdaskan kehidupan bangsa yang merupakan amanat yang harus diemban oleh negara. Tujuan negara tersebut dapat diwujudkan dengan memberikan hak atas pendidikan kepada setiap warga negara. Hak atas pendidikan juga merupakan hak asasi manusia. Tujuan melakukan kajian/penelitian ini adalah untuk menganalisis kesesuaian Peraturan Gubernur Jawa Tengah Nomor 9 Tahun 2019 tentang Penerimaan Peserta Didik Baru (PPDB) pada Sekolah Menengah Atas Negeri dan Sekolah Menengah Kejuruan Negeri di Provinsi Jawa Tengah berikut perubahannya dengan nilai-nilai Pancasila, prinsip- prinsip hak konstitusional serta hak asasi manusia. Mengingat Peraturan Gubernur ini terkait erat dengan hak atas pendidikan, kajian juga dilaksanakan dengan melihat praktik pelaksanaannya untuk mendapatkan beberapa temuan kontekstual-empiris yang dapat memperkaya hasil kajian. Penelitian ini masuk ranah penelitian kualitatif dengan metode pendekatan yuridis normatif. Spesifikasi penelitiannya adalah deskriptif analitis. Objek penelitiannya adalah isi/materi/substansi Peraturan Gubernur Jawa Tengah Nomor 9 Tahun 2019 berikut konsideran, dasar hukum, lampiran dan perubahannya yakni Peraturan Gubernur Jawa Tengah Nomor 22 Tahun 2019. Jenis data yang digunakan adalah data sekunder dengan teknik pengumpulan data melalui studi pustaka dan studi dokumen peraturan perundang-undangan. Analisis dilakukan secara kualitatif. Masalah riil yang ditemui dalam praktik umumnya adalah masalah teknis tentang cara pendaftaran secara on-line, masalah zonasi, masalah surat keterangan domisili (SKD) konversi poin kejuaraan untuk jalur prestasi, termasuk indikasi kecurangan berupa pemalsuan identitas dan/atau data adminduk. Isi/materi Peraturan Gubernur Nomor 9 Tahun 2019 berikut perubahannya secara asasi/prinsipil/substansiil tidak bertentangan dengan nilai-nilai dan sila-sila dalam Pancasila. Namun beberapa pasal berpotensi untuk bertentangan dengan nilai-nilai dan sila dalam Pancasila, hak konstitusional dan hak asasi manusia serta asas-asas pemerintahan yang baik (good governance) dalam bentuk diskriminasi. Rekomendasi untuk stakeholder adalah perlunya dilakukan evaluasi terus-menerus terhadap praktik pelayanan PPDB untuk mencegah diskriminasi. Peraturan Gubernur Nomor 9 Tahun 2019 jo. Peraturan Gubernur Nomor 22 tahun 2019 perlu direvisi karena ditemukannya kondisi ‘kelalaian’ dalam menuliskan dasar hukum, dimana dalam Peraturan Gubernur tidak disebutkan dasar hukum Peraturan Menteri Pendidikan dan Kebudayaan Nomor 70 Tahun 2009 tentang Pendidikan Inklusif bagi Peserta Didik yang Memiliki Kelainan dan Memiliki Potensi Kecerdasan dan/atau Bakat Istimewa sehingga berpotensi menimbulkan diskriminasi bagi siswa berkebutuhan khusus (difabel).
A Puskesmas or Health Center is one of the health service facilities having a duty of implementing health policies to achieve health development goals in its working area. Puskesmas is required to have accreditation every three years to ensure that quality and performance improvement and risk management implementation are continuously done. The accreditation is expected to guarantee the protection of the rights of the patients as service users of Puskesmas. There are 17 Puskesmas at Rembang District in which 94.1% of them have been accredited to see the degree of compliance with the Puskesmas accreditation standards.This study used a socio-legal approach having a descriptive-analytics specification. It used primary and secondary data meanwhile the data-gathering technique was conducted through field and literature studies. The data were then qualitatively analyzed.The results of the study showed that the accreditation to the Puskesmas of Rembang District was carried out according to the legislations of the Health Minister’s Regulation Nr. 75 of 2014 and the Health Minister’s Regulation Nr. 46 of 2015. One of the regulations on patient’s rights protection at Puskesmas was the Decree of Puskesmas Head regarding the patients’ rights to get services. The Puskesmas accreditation had been guaranteed the patients’ rights protection, but not optimally. Some factors were influencing the Puskesmas accreditation and the patients' rights protection to get health services at Puskesmas, namely juridical factors, technical factors, and other social factors.
