O presente artigo tem por escopo expor a in(constitucionalidade) da pronúncia do réu com base no princípio in dubio pro societate, levando em consideração a presunção de inocência. A priori dedica-se a apresentar um breve histórico da concepção de presunção de inocência, em seguida aborda-se a primeira fase do rito do júri, ao fim, uma análise sobre a constitucionalidade da pronúncia do réu com base apenas no princípio do in dubio pro societate, sendo uma solução inventada, sugerida e utilizada. Como objetivos específicos, abordar sobre os efeitos práticos da presunção de inocência no Processo Penal; investigar a correlação com a ideia de in dúbio pro societate, bem como o efeito de noção da presunção de inocência no resultado da dúvida no Estado Democrático de Direito; apresentar a primeira fase do rito do Tribunal do Júri, e as dúvidas que eventualmente possam surgir ao final desta primeira fase, a exemplo do dolo e a matéria do crime.
