O presente artigo tem como finalidade verificar a responsabilidade penal por omissão imprópria, a qual está prevista em nosso ordenamento jurídico no artigo 13, § 2º, alíneas a, b, c do Código Penal e que desta surge a figura do Garante. Neste sentido a temática visa entender se o compliance officer assume este papel, investido do dever e poder de agir. Em primeiro momento, o texto se dedica a apresentar o conceito de compliance, como é implementado no direito penal e previsão legal sobre o tema. Posteriormente define o compliance officer, suas atribuições e responsabilidades, a omissão imprópria, da qual surge o garante. Em segundo momento, verifica-se o entendimento doutrinário acerca da responsabilidade penal do compliance officer, individualizando e explicando cada alínea do artigo 13, §2º do Código Penal. Ainda, se verifica a atribuição de responsabilidade penal a partir de teorias construídas doutrinariamente, as quais são a Teoria da Ação Significativa, do Domínio do Fato e a Cegueira Deliberada. Por fim, após está construção doutrinaria, verifica-se em casos práticos, analisando a jurisprudência brasileira se há o entendimento que o compliance officer é um autêntico garante, e, sendo, quais fundamentos foram utilizados para atribuir a ele a responsabilidade penal omissiva.
Este trabalho traz um breve estudo sobre o princípio da culpabilidade na matéria de direito penal, com enfoque na aplicação da culpabilidade quando da primeira fase de fixação da pena através da análise das circunstâncias judiciais elencadas no artigo 59 do Código Penal. Fora utilizado o método dedutivo para a construção deste artigo a partir de uma pesquisa com abordagem qualitativa de natureza básica com objetivo explicativo, através do procedimento bibliográfico. Sua justificativa se dá na medida em que se questiona a legitimidade das circunstâncias judiciais para aferir a pena-base do acusado em face de um direito penal do fato e não do autor. Tendo como problematização as discrepâncias e discordâncias doutrinária e jurisprudencial acerca da efetividade dos elementos do artigo 59 e a forma de aplicação da culpabilidade no processo penal. Observando o teor subjetivo de cada uma das circunstâncias e se há a possibilidade de uma atualização no conceito de culpabilidade visando dar maior efetividade ao princípio da individualização das penas e da presunção de inocência. Por fim, é apresentada a teoria da co-culpabilidade como uma possível contramedida em face do direito penal expansionista atual.
O presente artigo tem por escopo expor a in(constitucionalidade) da pronúncia do réu com base no princípio in dubio pro societate, levando em consideração a presunção de inocência. A priori dedica-se a apresentar um breve histórico da concepção de presunção de inocência, em seguida aborda-se a primeira fase do rito do júri, ao fim, uma análise sobre a constitucionalidade da pronúncia do réu com base apenas no princípio do in dubio pro societate, sendo uma solução inventada, sugerida e utilizada. Como objetivos específicos, abordar sobre os efeitos práticos da presunção de inocência no Processo Penal; investigar a correlação com a ideia de in dúbio pro societate, bem como o efeito de noção da presunção de inocência no resultado da dúvida no Estado Democrático de Direito; apresentar a primeira fase do rito do Tribunal do Júri, e as dúvidas que eventualmente possam surgir ao final desta primeira fase, a exemplo do dolo e a matéria do crime.
Este artigo pretende mostrar, a partir da filosofia da linguagem de Wittgenstein e da teoria da ação significativa de S. Vives Antón, de que modo o discurso jurídico-penal acerca da corrupção não é um fenômeno empiricamente descritivo, mas, ao contrário, conceitual. Neste sentido, argumenta-se que se há uma narrativa metodológica sobre a corrupção, então, também deve ser verdadeiro pensar que há uma determinação conceitual que permite a manutenção do significado na avaliação da possibilidade ou não de sua consumação. Mas, efetivamente, poder-se-ia tomar o significado do termo corrupção independentemente de uma prática como sustenta a teoria da ação significativa de V. Antón? Haveria um binômio entre o conteúdo conceitual e os fenômenos que são por este descritos e abarcados? Ou, ao contrário, o discurso jurídico-penal continuaria a repetir o jargão culturalista ilustrado pela hipótese de que a melhor fonte para entender a corrupção deveriam ser as histórias produzidas por aquelas mesmas pessoas que tiveram o olhar mais próximo do fenômeno e, talvez, até mesmo foram cúmplices de ações corruptas? Mostra-se, por fim, que a corrupção engendra não apenas um problema lógico-dedutivo ao Direito Penal, mas também a pressuposição que a práxis está de um lado e, a norma, de outro, conforme concebe Vives Antón ao afirmar que a ação penal deve ser vista a partir de seu significado.
