Resumo A Constituição Federal de 1988, no artigo 170, dispõe que as empresas privadas compõem a ordem econômica do país e, portanto, são responsáveis, ao lado do Estado neoliberal que é o Brasil, pela produção de riqueza nacional e o avanço social e econômico da população. Também é corolário constitucional que esse desenvolvimento econômico esbarra em contornos sociais, jurídicos e econômicos que garantam aos cidadãos brasileiros sua dignidade. Em se tratando de exploração nanotecnológica observa-se que esses ditames não vêm sendo cumpridos pelo Estado que permite, e pelas empresas que colocam em circulação, bens de toda ordem manufaturados a partir de nanotecnologia, sem a segurança social necessária diante de inúmeras vantagens econômicas. Constata-se, portanto, que há uma operação matemática de custos, perdas e lucros, cujos fatores estão em desajuste com a pretensão do legislador constituinte. Por que se adota essa política governamental e corporativa no Brasil? Qual seria o cálculo perfeito para atender ao equilíbrio pretendido pelo legislador constituinte? Essas perguntas percorrerão a pesquisa que não tem o condão de esgotar o tema; mas, ao final, provavelmente, constatar-se-á que a análise econômica do Direito da Escola de Chicago e que já vem sendo reconhecida pelo Sistema Judiciário nacional pode auxiliar o Brasil na construção de solução para o dilema segurança versus lucro, justamente, para percorrer o desafio de construir uma sociedade justa e igualitária, fins políticos colimados na Carta Constitucional. In this global hipecomplexity scenario, developing countries are called upon to contribute a portion of the reduction of these complexities in order to the sustainable development described in Agenda 2030 to be fulfilled. Around Brazil, there is the expectation that this contribution will be significant in view of the fortunate territory it occupies. However, such targets are far from being achieved by the country in face of its poorly developed system and this is a problem for the research. The general objective is to demonstrate that these are two flawed sides of the same coin: the internal, because of little systemic understanding of global communication that includes the role of institutions and new technologies; owing to the low contribution and lack of management of this global systemic communication that goes beyond resources provided in developing countries. As specific objectives, the research intends to demonstrate that this scenario is due to the low national production complexity characterized by trade in goods and services by 80% of the brazilian companies, distributed among small and medium enterprises, which, in turn, are not involved in planning and technological development, with special attention to disruptive nanotechnologies; as a consequence do not contribute to the sustainable development set out in agenda 2030. The initial hypothesis assumes two aspects: for the internal system, the contribution of sectoral institutions in the diffusion of communication involving technological innovation and sustainable development; and, for the global system: direct engagement in the management of resources and in the construction of this systemic communication. The metodology of the research is deductive and adopts the systemic-constructivist perspective as a procedure to arrive at the solution. The research techniques go through the collection of data and documents submitted to the analysis through the bibliographic review.
RESUMOEu se divorciou de Tu e relacionou-se promíscua e intensamente com Isso. Um descompasso entre o desenvolvimento humano e o econômico é promovido pelo excesso de técnica. As nanotecnologias são ferramentas mágicas de acumulação. As sociedades padecem dos riscos. O homem encontra-se escravizado pela técnica.
